وإذا كان الطرف المتعاقد السامي غير قادر على الامتثال للفقرة 1 من هذه المادة في غضون الفترة التي أعلنها، جاز له أن يخطر الوديع بأنه سيمدد فترة تأجيل الامتثال هذه مدةً تصل إلى 4 سنوات إضافية.

4. During a period of deferred compliance pursuant to paragraph 3 of this Article, a High Contracting Party shall not use cluster munitions, other than those described in Technical Annex B, except:
4- خلال فترة تأجيل الامتثال بموجب الفقرة 3 من هذه المادة، لا يستخدم الطرف المتعاقد السامي الذخائر العنقودية غير تلك المبينة في المرفق التقني `باء` إلا في الحالتين التاليتين:

17. The Conference considered the issue on the deferral of compliance with paragraphs 2 (b) and 3 (a) and/or (b) of the Technical Annex of Amended Protocol II, as permitted under paragraphs 2 (c) and 3 (c) of the Technical Annex.
17- ونظر المؤتمر في مسألة تأجيل الامتثال للفقرتين 2(ب) و3(أ) و/أو (ب) من المرفق التقني للبروتوكول الثاني المعدل، على النحو المسموح به بموجب الفقرتين 2(ج) و3(ج) من المرفق التقني.

In case a High Contracting Party is unable to comply with paragraph 1 of this Article within the period it announced by declaration, it may notify the Depositary that it will extend this period of deferred compliance for up to four additional years.

(ii) the end of the period of deferred compliance referred to in paragraph 2 of Article 4 if applicable to the High Contracting Party, where that period is greater than 5 years in duration; and

In case a High Contracting Party is unable to comply with paragraph 2 of this article within the period it announced by declaration, it may notify the Depositary that it will extend this period of deferred compliance for up to four additional years.
وإذا كان الطرف المتعاقد السامي غير قادر على الامتثال للفقرة 2 من هذه المادة في غضون الفترة التي أعلنها، جاز له أن يخطر الوديع بأنه سيمدد فترة تأجيل الامتثال هذه مدةً تصل إلى 4 سنوات إضافية.

3. During a period of deferred compliance pursuant to paragraph 2 of this Article, a High Contracting Party shall only use cluster munitions, other than those described in Technical Annex B, after approval by its highest-ranking operational commander in the area of operations or by the appropriate politically mandated operational authority.
3- خلال فترة تأجيل الامتثال بموجب الفقرة 2 من هذه المادة، لا يستخدم الطرف المتعاقد السامي الذخائر العنقودية غير تلك المبينة في المرفق التقني باء إلا بعد موافقة صادرة عن القائد الأعلى رتبة في مسرح العمليات أو عن سلطة العمليات المناسبة المفوّضة سياسياً؛

5. During a period of deferred compliance pursuant to paragraph 3 of this Article, a High Contracting Party shall not transfer any cluster munition or submunition, other than those described in Technical Annex B, unless the recipient State agrees to:
5- يمتنع الطرف المتعاقد السامي أثناء فترة تأجيل الامتثال عملاً بالفقرة 3 من هذه المادة عن نقل أي ذخيرة عنقودية أو ذخيرة فرعية غير تلك المبينة في المرفق التقني باء، إلا إذا وافقت الدولة المتلقية على ما يلي:

17. Mr. Spector (United States of America) said that the United States of America strongly supported draft protocol VI in its current form, which contained a comprehensive set of provisions that would have an immediate and substantial humanitarian impact on the ground, and would provide additional benefits over time, after the period of deferred compliance.
17- وقال السيد سبيكتور (الولايات المتحدة الأمريكية) إن الولايات المتحدة تدعم مشروع البروتوكول السادس بشكله الحالي لأنه يتضمن أصلاً مجموعة متكاملة من الأحكام الجديرة بإحداث تأثير إنساني فوري ومهم على أرض الواقع، وأن من الممكن أن يثمر مزايا كثيرة أخرى مع مرّ الزمن، بعد انقضاء فترة تأجيل الامتثال.
