10- السيد تانغ هوتشي (الصين): قال إن توقيع وثيقة ما أمر مهم جدا في القانون الصيني الخاص بالاجراءات والتحكيم.

51. Mr. Tang Houzhi (China) said that his delegation agreed with the content of article 1, paragraph (8).
51- السيد تانغ هوتشي (الصين): قال إن وفده يوافق على مضمون الفقرة (8) من المادة 1.

52. Mr. Tang Houzhi (China) said he understood that the Commission had to take a neutral position on the question and was anxious to promote the development of international conciliation in commercial matters.
52- السيد تانغ هوتشي (الصين): قال إنه يتفهم أن على اللجنة أن تتخذ موقفا حياديا بشأن هذه المسألة وأنها تواقة إلى تنمية العمل على إرساء التوفيق الدولي في المسائل التجارية.

48. Mr. Tang Houzhi (China) said that his delegation strongly supported the inclusion of a reference to draft article 15 in draft article 3.
48- السيد تانغ هوتشي (الصين): قال إن وفده يؤيد بشدة ادراج اشارة إلى مشروع المادة 15 في مشروع المادة 3.

31. Mr. Tang Houzhi (China) said that in the interests of expediting the Commission's work, his delegation had several observations.
31- السيد تانغ هوتشي (الصين): قال إنه من أجل الاسراع في عمل اللجنة، فان لدى وفده بعض الملاحظات.

36. Mr. Tang Houzhi (China) said that the paragraph should not be deleted, since it reflected the considered view of the Working Group.
36- السيد تانغ هوتشي (الصين): قال إن الفقرة لا ينبغي أن تحذف، لأنها تجسد الرأي الذي خلص اليه الفريق العامل.

49. Mr. Tang Houzhi (China) said that his delegation supported the statement made by Singapore and requested the secretariat to improve on the paragraph.
49- السيد تانغ هوتشي (الصين): ذكر أن وفده يؤيد البيان الذي أدلت به سنغافورة وطلب إلى الأمانة أن تحسن صيغة الفقرة.

56. Mr. Tang Houzhi (China) said it was to be hoped that the secretariat would make the appropriate changes.
56- السيد تانغ هوتشي (الصين): قال إنه من المأمول أن تجري الأمانة التغييرات المناسبة.

15. Mr. Tang Houzhi (China) said that the United States proposal did not reflect the discussion.
15- السيد تانغ هوتشي (الصين): قال ان مقترح الولايات المتحدة لا يجسّد المناقشة.

31. Mr. Tang Houzhi (China) said he agreed with the French representative that draft article 15 should be mandatory and should be included in draft article 3.
31- السيد تانغ هوتشي (الصين): قال إنه يتفق مع ممثل فرنسا في أن مشروع المادة 15 ينبغي أن يكون إلزاميا وينبغي أن يُدرج في مشروع المادة 3.

38. Mr. Tang Houzhi (China) said that no further compromise solution was necessary, since the text had already been agreed by the Working Group.
38- السيد تانغ هوتشي (الصين): قال إنه ليس من اللازم اقتراح أي حل توفيقي إضافي، لأن الفريق العامل قد اتفق على النص من قبل.

62. Mr. Tang Houzhi (China) said that, in his country, insolvency disputes had to be resolved in court, as no conciliation regime existed; however, there was no law against resolving such disputes through conciliation procedures.
62- السيد تانغ هوتشي (الصين): قال إنه، في بلده، لا بد أن تسوى نزاعات الإعسار في المحكمة، بسبب عدم وجود نظام للإعسار؛ بيد أنه لا يوجد قانون يمنع تسوية هذه النـزاعات من خلال إجراءات التوفيق.

4. Mr. Tang Houzhi (China) said that during the discussions in the Working Group and the Commission, he had failed to understand why there was such resistance to agreements reached by the parties.
4- السيد تانغ هوتشي (الصين): قال انه خلال المناقشات في إطار الفريق العامل واللجنة أيضا، تعذّر عليه أن يفهم لماذا كان هناك مثل هذه الممانعة بشأن الاتفاقات التي يتوصّل اليها الأطراف.

8. Mr. Tang Houzhi (China) said that, in the view of his delegation, the words " unless otherwise agreed by the parties " were extremely important. It should be possible for parties, having failed to reach a settlement after conciliation, to agree to pursue the process with the same person as arbitrator.
8- السيد تانغ هوتشي (الصين): قال إن وفده يرى أن العبارة " ما لم يتفق الطرفان على حكم مخالف " في غاية الأهمية، إذ ينبغي أن يكون ممكنا للطرفين، لدى عدم توصلهما إلى تسوية بعد التوفيق، الاتفاق على مواصلة العملية مع الشخص نفسه كمحكـّم.

47. Mr. Tang Houzhi (China) said there seemed to be something missing in the third operative paragraph after " due consideration to " .
47- السيد تانغ هوتشي (الصين): قال انه يبدو أن هناك شيئا ناقصا في الفقرة الثالثة من المنطوق بعد العبارة " الاهتمام الواجب " .

28. Mr. Tang Houzhi (China), drawing attention to original draft article 16 (A/CN.9/506, para. 130), entitled " Arbitrator acting as conciliator " , recalled that although there had been no opposition to the content of that paragraph, the Working Group had deleted it and decided that an explanatory note would be included in the Guide.
28- السيد تانغ هوتشي (الصين): في معرض استرعائه الانتباه إلى مشروع المادة 16 في صيغتها الأصلية (الوثيقة A/CN.9/506، الفقرة 130)، المعنونة " قيام المحكـّم بدور الموفـّق " ، ذكـّر بأنه على الرغم من عدم وجود أي معارضة لمضمون تلك الفقرة، فقد حذفها الفريق العامل وقرر ادراج ملاحظة توضيحية في الدليل في هذا الصدد.
