(هـ) استحداث تدابير لضمان المساواة أمام القانون، لا سيما فيما يتعلق بالتمتع بالحق في المساواة في المعاملة أمام المحاكم وجميع الهيئات الأخرى التي تتولى إقامة العدل. ووضع تدابير فعالة للقضاء على الظاهرة المعروفة باسم " التنميط العنصري " ، وتنفيذ تلك التدابير وإنفاذها؛

Article 5 of ICERD explicitly prohibits racial discrimination with respect to the " right to equal treatment before [...] all [...] organs administering justice " and to " freedom of movement " .
