9. In accordance with article 2, paragraph 3 (a), of the Covenant, the State party is under an obligation to provide the author with an effective remedy, including compensation if her property cannot be returned.
9- ووفقاً للفقرة 3(أ) من المادة 2 من العهد، فإن الدولة الطرف ملزمة بأن تتيح لصاحبة البلاغ سبيل انتصاف فعالاًُ، بما في ذلك التعويض المالي إذا تعذر عليها ردّ الممتلكات.

224. In case No. 1493/2006 (Williams Lecraft v. Spain), concerning the violation of article 26 as a result of a police identity check based on racial grounds, the Committee considered that the State party was under an obligation to provide the author with an effective remedy, including a public expression of regret.
224- وفي القضية رقم 1493/2006 (ويليامس لوكرافت ضد إسبانيا)، المتعلقة بانتهاك المادة 26 نتيجة لعملية التدقيق في وثائق هوية صاحبة البلاغ من قبل الشرطة على أساس اعتبارات عنصرية، اعتبرت اللجنة أن الدولة الطرف ملزمة بأن تتيح لصاحبة البلاغ سبيل انتصاف فعالاًً، بما يشمل الاعتذار لها علناً.

224. In case No. 1493/2006 (Williams Lecraft v. Spain), concerning the violation of article 26 as a result of a police identity check based on racial grounds, the Committee considered that the State party was under an obligation to provide the author with an effective remedy, including a public expression of regret.
224 - وفي القضية رقم 1493/2006 (ويليامس لوكرافت ضد إسبانيا)، المتعلقة بانتهاك المادة 26 نتيجة لعملية التدقيق في وثائق هوية صاحبة البلاغ من قبل الشرطة على أساس اعتبارات عنصرية، اعتبرت اللجنة أن الدولة الطرف ملزمة بأن تتيح لصاحبة البلاغ سبيل انتصاف فعالاًً، بما يشمل الاعتذار لها علناً.

235. In case No. 1548/2007 (Kholodova v. Russian Federation), involving the violation of article 2, paragraph 3 (a) in conjunction with article 6, paragraph 1 of the Covenant, the State party was requested to provide the author with an effective remedy and take all possible measures to ensure that those responsible for the death of her son are brought to justice.
235- وفي القضية رقم 1548/2007 (خولودوفا ضد الاتحاد الروسي)، التي انطوت على انتهاك للفقرة 3(أ) من المادة 2 بالاقتران مع الفقرة 1 من المادة 6 من العهد()، طُلب إلى الدولة الطرف أن تتيح لصاحبة البلاغ سبيل انتصاف فعالاً، وأن تتخذ كافة التدابير الممكنة لضمان تقديم المسؤولين عن وفاة ابنها إلى العدالة.

244. In case No. 1787/2008 (Kovsh v. Belarus), where the Committee concluded that the detentions of the author were incompatible with article 9, paragraph 3 of the Covenant, the State party was requested to provide the author with an effective remedy, including reimbursement of any legal costs incurred by her, as well as adequate compensation.
244- وفي القضية رقم 1787/2008 (كوفش ضد بيلاروس)، خلصت اللجنة إلى أن حالتي احتجاز صاحبة البلاغ تتعارضان مع أحكام الفقرة 3 من المادة 9 من العهد، وطُلب إلى الدولة الطرف أن تتيح لصاحبة البلاغ سبيل انتصاف فعالاً يشمل سداد أية تكاليف قانونية تكبدتها فضلاً عن تعويض مناسب.

12. In accordance with article 2, paragraph 3 (a), of the Covenant, the State party is under an obligation to provide the author with an effective remedy, including reimbursement of the value of the fine as at the situation of April 2009 and any legal costs incurred by the author, as well as compensation.
12- وترى اللجنة أنه عملاً بالفقرة 3(أ) من المادة 2 من العهد فإن الدولة الطرف ملزمة بأن تتيح لصاحبة البلاغ سبيل انتصاف فعالاً، بما يشمل سداد قيمة الغرامة وقت فرضها في نيسان/أبريل 2009 وأية مصاريف قانونية تحملتها صاحبة البلاغ، إضافة إلى تعويضها.

9. In accordance with article 2, paragraph 3 (a), of the Covenant, the State party is under an obligation to provide the author with an effective remedy, which includes ensuring that perpetrators are brought to justice, that the author and her two children can return to their domicile in safety, and ensure reparation, including payment of adequate compensation and an apology to the family.

10. In accordance with article 2, paragraph 3 (a), of the Covenant, the State party is under an obligation to provide the author with an effective remedy, including compensation, as well as to amend its legislation concerning exit from the country to comply with the provisions of the Covenant.
10 - ووفقاً لأحكام الفقرة 3 (أ) من المادة2 من العهد، يقع على عاتق الدولة الطرف التزام بأن تتيح لصاحبة البلاغ سبيل انتصاف فعالاً، بما في ذلك التعويض، فضلاً عن تعديل تشريعاتها المتعلقة بإجراءات الخروج من البلد بحيث تمتثل لأحكام العهد.
