In the present report, the Special Rapporteur notes with appreciation a number of initiatives taken at the national and regional levels to prevent the trade and production in equipment specifically designed to inflict torture or other cruel, inhuman or degrading treatment.
وفي هذا التقرير، ينوّه المقرر الخاص مع التقدير بعدد من المبادرات المتخذة على الصعيدين الوطني والإقليمي لمنع تجارة وإنتاج المعدات المصممة خصيصاً للتعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة.

4. In accordance with the above-mentioned resolutions, the Special Rapporteur hereby submits a preliminary study on the question of the trade in and production of equipment specifically designed to inflict torture and other forms of ill-treatment.
4- ووفقاً للقرارين المذكورين أعلاه، يقدم المقرر الخاص هذه الدراسة الأولية عن مسألة تجارة وإنتاج المعدات المصممة خصيصاً للتعذيب وغيره من ضروب سوء المعاملة.

The Special Rapporteur expresses the wish that he will be able to carry out further work on this issue with a view to finding the best ways to prohibit trade in and production of equipment specifically designed to inflict torture or other cruel, inhuman or degrading treatment.
68- ويعرب المقرر الخاص عن أمله في أن يتمكن في المستقبل من اتخاذ مزيد من الإجراءات بشأن هذه المسألة بغية إيجاد أفضل السبل لمنع تجارة وإنتاج المعدات المصممة خصيصاً لممارسة التعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة.

Committee members were particularly interested in the study submitted by the Special Rapporteur to the Commission on the situation of trade in and production of equipment which is specifically designed to inflict torture or other cruel, inhuman or degrading treatment, its origin, destination and forms (E/CN.4/2003/69).
وقد اهتم أعضاء اللجنة اهتماماً خاصاً بالدراسة المقدمة من المقرر الخاص إلى لجنة حقوق الإنسان بشأن حالة تجارة وإنتاج المعدات المصممة خصيصاً لممارسة التعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، وعن منشأ هذه المعدات ووجهتها وأشكالها (E/CN.4/2003/69).

The Special Rapporteur draws attention to document E/CN.4/2005/62 containing the final version of the " Study on the situation of trade in and production of equipment which is specifically designed to inflict torture or other cruel, inhuman or degrading treatment, its origin, destination and forms. "
2 - ويوجه المقرر الخاص الاهتمام إلى الوثيقة E/CN.4/2005/62، التي تشتمل على النسخة النهائية من " دراسة أوضـاع تجارة وإنتاج المعدات المصممة خصيصاً لممارسة التعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، ومنشئها ووجهتها وأشكالها " .

ويحتوي الفصل الخامس بعض المعلومات عن متابعة الدراسة التمهيدية التي أجراها المقرر الخاص عن حالة تجارة وإنتاج المعدات المصممة خصيصاً لممارسة التعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، وعن منشأ هذه المعدات ووجهتها وأشكالها (E/CN.4/2003/69).

The Special Rapporteur refers to his preliminary study on the situation of trade in and production of equipment which is specifically designed to inflict torture or other cruel, inhuman or degrading treatment, its origin, destination and forms, where he noted: " The legitimate use of ... some restraints (such as handcuffs) and kinetic and chemical devices is recognized in a number of appropriate circumstances ....
46- ويشير المقرر الخاص إلى دراسته التمهيدية عن حالة تجارة وإنتاج المعدات المصممة خصيصاً لممارسة التعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، وعن منشأ هذه المعدات ووجهتها وأشكالها، حيث لاحظ أن " ثمة أنواع معينة من هذه المعدات، لاسيما بعض أدوات الكبح وتقييد الحرية (كأغلال الأيدي) وبعض الأجهزة الحركية والكيميائية، ويجوز استخدامها استخداماً مشروعاً في عدد من الظروف المناسبة.

18. In paragraph 9 of its resolution 2001/62, the Commission on Human Rights requested the Special Rapporteur to study the situation of trade and production in equipment which is specifically designed to inflict torture or other cruel, inhuman or degrading treatment, its origin, destination and forms, with a view to finding the best ways to prohibit such trade and production and to combat its proliferation, and report thereon to the Commission.
18- وطلبت لجنة حقوق الإنسان إلى المقرر الخاص في الفقرة 9 من قرارها 2001/62 أن يدرس أوضاع تجارة وإنتاج المعدات المصممة خصيصا لممارسة التعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهنية، ومنشأها والجهة المرسلة إليها وأشكالها، وذلك بغية إيجاد أفضل السبل لحظر مثل هذه التجارة وهذا الإنتاج ومكافحة انتشارهما، وأن يقدم تقريراً عن ذلك إلى اللجنة.

Also in resolution 2001/62, the Commission requested the Special Rapporteur to study the situation of trade and production in equipment, which is specifically designed to inflict torture or other cruel, inhuman or degrading treatment, its origin, destination and forms, with a view to finding the best ways to prohibit such trade and production and to combat its proliferation, and to report thereon to the Commission.
كما رجت اللجنة في قرارها 2001/62 من المقرر الخاص أن يبحث حالة تجارة وإنتاج المعدات المصممة خصيصاً لإنزال التعذيب أو العقوبة القاسية أو اللاإنسانية أو المهينة وأصلها والجهات الموجهة إليها وأشكالها بغية الاهتداء إلى أفضل السبل لحظر هذه التجارة وهـذا النوع من الإنتاج ولمكافحة تفشيها وتقديم تقرر عن ذلك إلى اللجنة.
