His delegation welcomed the intention to consider the practice of States from all regions of the world, which was particularly important for the development of a general approach on how to identify customary international law.
وأعرب عن ترحيب وفده باعتزام أخذ ممارسات الدول من جميع مناطق العالم في الحسبان، وهو الأمر الذي يتسم بأهمية خاصة فيما يتعلق بوضع نهج عام بشأن كيفية تحديد القانون الدولي العرفي.

His delegation considered that the approach to identifying customary international law should not vary for different branches of international law but should be uniform.

At the same session, the Commission decided to change the title of the topic to " Identification of customary international law " .
وفي الدورة نفسها، قررت اللجنة تغيير عنوان الموضوع ليصبح " تحديد القانون الدولي العرفي " .

It had also held a useful debate on the topic of formation and evidence of customary international law, whose title has been changed to " Identification of customary international law " , as well as on the topic of provisional application of treaties.
وعقدت اللجنة أيضا مناقشة مفيدة بشأن موضوع نشأة القانون الدولي العرفي وإثباته، الذي تغيَّر عنوانه ليُصبح " تحديد القانون الدولي العرفي " ، وبشأن موضوع التطبيق المؤقت للمعاهدات.

The Commission had decided to change the name of the topic to " Identification of customary international law " , which more clearly indicated the proposed focus of the Commission's work, namely, the method of identifying rules of customary international law.
وقد قررت اللجنة تغيير اسم الموضوع ليصبح " تحديد القانون الدولي العرفي " ، وهو ما يشير بصورة أوضح إلى التركيز المقترح لعمل اللجنة، أي طريقة تحديد قواعد القانون الدولي العرفي.

13. With regard to the topic of formation and evidence of customary international law, his delegation welcomed the Commission's decision to change the title to " Identification of customary international law " , thereby clarifying the scope of the topic and giving it a practical focus.
13 - وفيما يتعلق بموضوع نشأة القانون الدولي العرفي وإثباته، قال إن وفده يرحب بقرار اللجنة بتغيير العنوان ليصبح " تحديد القانون الدولي العرفي " ، موضحة بذلك نطاق الموضوع ومضفية عليه طابعا عمليا.

163. The experience of those who had tried to identify customary international law in particular fields, such as the authors of the study commissioned by the International Committee of the Red Cross (ICRC) on " Customary International Humanitarian Law " , could make a significant contribution to the topic.
163- ولعل تجربة أولئك الذين حاولوا تحديد القانون الدولي العرفي في مجالات معينة، مثل مؤلفي الدراسة التي صدر بها تكليف من اللجنة الدولية للصليب الأحمر عن " القانون الإنساني الدولي العرفي " ()، تضيف إسهاماً في هذا الموضوع.

The Commission was also urged to proceed with caution in considering the role of unilateral acts in identifying customary international law.
وحُثّت اللجنة أيضا على التعامل بحذر حين النظر في دور الأعمال الانفرادية في تحديد القانون الدولي العرفي.
