8. This provision introduces the obligation of the States parties to take effective measures to prevent acts of torture.
8- يُلزِم هذا الحكم الدول الأطراف باتخاذ تدابير فعالة لمنع أعمال التعذيب.

Recalling that articles 2 and 16 of the Convention oblige each State Party to take effective measures to prevent acts of torture and other cruel, inhuman or degrading treatment or punishment in any territory under its jurisdiction,
وإذ تشير إلى أن المادتين 2 و 16 من الاتفاقية تلزمان كل دولة طرف باتخاذ تدابير فعالة لمنع أعمال التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة في أي إقليم يخضع لولايتها،

وإذ تشير الى أن المادتين 2 و16 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاانسانية أو المهينة تنصان على أن تتخذ كل دولة طرف تدابير فعالة لمنع أعمال التعذيب وغيرها من أعمال المعاملة أو العقوبة القاسية أو اللاانسانية أو المهينة في أي إقليم يخضع لاختصاصها القانوني،

10.7 Counsel also considers that the State party failed to take effective measures to prevent acts of torture in this case, in violation of article 2 of the Convention against Torture.
10-7 وترى المحامية أيضاً أن الدولة الطرف لم تتخذ تدابير فعالة لمنع أعمال التعذيب في القضية قيد البحث، مما يشكل انتهاكاً للمادة 2 من اتفاقية مناهضة التعذيب.

(a) Take effective measures to prevent acts of torture and ill-treatment in its territory, in view of the persistent reports that torture is still regularly practised;
(أ) اتخاذ تدابير فعالة لمنع أعمال التعذيب وسوء المعاملة في إقليمها، بالنظر إلى استمرار التقارير بأن التعذيب لا يزال يمارس بصورة منتظمة؛

16. Article 2, paragraph 1, requires that each State party shall take effective measures to prevent acts of torture not only in its sovereign territory but also " in any territory under its jurisdiction. "
16- وتقضي الفقرة 1 من المادة 2 بأن تتخذ كل دولة طرف تدابير فعالة لمنع أعمال التعذيب لا في الإقليم الخاضع لسيادتها فحسب، وإنما أيضاً " في أي إقليم يخضع لاختصاصها القضائي " .

16. Article 2, paragraph 1, requires that each State party shall take effective measures to prevent acts of torture not only in its sovereign territory but also " in any territory under its jurisdiction. "
16 - وتقضي الفقرة 1 من المادة 2 بأن تتخذ كل دولة طرف تدابير فعالة لمنع أعمال التعذيب لا في الإقليم الخاضع لسيادتها فحسب، وإنما أيضاً " في أي إقليم يخضع لاختصاصها القضائي " .

3.8 The complainant claims that, with regard to the alleged violation of articles 1 and 2 taken together, the State party failed in its duty to take effective measures to prevent acts of torture and used its own security forces to submit the complainant to acts comparable to acts of torture.
3-8 وتؤكد صاحبة الشكوى، فيما يتعلق بادعاء انتهاك المادتين 1 و2 مقترنتين، أن الدولة الطرف أخلت بواجبها اتخاذ تدابير فعالة لمنع أعمال التعذيب واستخدمت قوات أمنها لإخضاع صاحبة الشكوى لمثل هذه الأفعال، وهي أفعال يمكن اعتبارها تعذيباً.

3.8 The complainant claims that, with regard to the alleged violation of articles 1 and 2 taken together, the State party failed in its duty to take effective measures to prevent acts of torture and used its own security forces to submit the complainant to acts comparable to acts of torture.
3-8 وتؤكد صاحبة الشكوى، فيما يتعلق بادعاء انتهاك المادتين 1 و 2 مقترنتين، أن الدولة الطرف أخلت بواجبها اتخاذ تدابير فعالة لمنع أعمال التعذيب واستخدمت قوات أمنها لإخضاع صاحبة الشكوى لمثل هذه الأفعال، وهي أفعال يمكن اعتبارها تعذيباً.

84. Complaint No. 291/2006 (Saadia Ali v. Tunisia), concerned a French-Tunisian national who claimed a violation of articles 1 and 2, as the State party had failed in its duty to take effective measures to prevent acts of torture and used its own security forces to submit the complainant to acts comparable to acts of torture.
84- وتتعلق الشكوى رقم 291/2006 (سعدية علي ضد تونس) بمواطنة فرنسية تونسية ادعت انتهاك المادتين 1 و2، لأن الدولة الطرف أخلت بواجب اتخاذها تدابير فعالة لمنع أعمال التعذيب واستخدمت قوات أمنها لإخضاع صاحبة الشكوى لأفعال يمكن اعتبارها تعذيباً.
