لكي نمضي الى الجزء الخاص بالمنظمات غير الحكومية في برنامجنا المقرر لجلسة هذا الصباح، اقترح أن نستمع الى باقي المتكلمين في هذه الجلسة بعد الانتهاء من ذلك الجزء الــذي أعدت له ترتيبات لوجستية خاصة.

(أ) دعم البلدان النامية غير الساحلية وبلدان المرور العابر في تنفيذ الاتفاقيات والاتفاقات الدولية المتعلقة بتيسير المرور العابر والمبادرات التي تعزز التعاون في مجال المرور العابر وتخفض تكاليف النقل وتضع ترتيبات لوجستية مرنة؛

3. The arbitral tribunal shall make logistical arrangements to facilitate the public access to hearings (including where appropriate by organizing attendance through video links or such other means as it deems appropriate).
3- تتَّخذ هيئة التحكيم ترتيبات لوجستية لتيسير علانية جلسات الاستماع (تشمل، عند الاقتضاء، تنظيم بثها لعامة الناس بواسطة وصلات فيديوية أو أيِّ وسائل أخرى من هذا القبيل تراها مناسبة).

" Operation lighthouse " , an initiative launched at the request of the World Food Programme (WFP) in October 2013, provided special logistical arrangements which enabled 612 WFP convoys to deliver 16,669 tons of food to those in need in Darfur.

It was noted that paragraph (3) contained two elements, the arbitral tribunal's power to make logistical arrangements to provide public access to the hearings and its discretion to close the hearings for logistical reasons.
104- ذُكر أنَّ الفقرة (3) تتضمّن عنصرين هما سلطة هيئة التحكيم في اتخاذ ترتيبات لوجستية لتمكين الجمهور من حضور جلسات الاستماع، وصلاحيتها التقديرية في عقد جلسات استماع مغلقة لأسباب لوجستية.

Rule 32 (2) of the ICSID Arbitration Rules read as follows: " Unless either party objects, the Tribunal, after consultation with the Secretary-General, may allow other persons, besides the parties, their agents, counsel and advocates, witnesses and experts during their testimony, and officers of the Tribunal, to attend or observe all or part of the hearings, subject to appropriate logistical arrangements.
وتنص المادة المذكورة على أنه " يجوز لهيئة التحكيم، بعد التشاور مع الأمين العام، أن تسمح لأشخاص آخرين، إلى جانب الطرفين ووكلائهما ومستشاريهما ومحاميهما، وكذلك للشهود والخبراء أثناء الإدلاء بشهادتهم، ولموظفي الهيئة، بأن يَحضروا أو يراقبوا كل جلسات الاستماع أو جزءاً منها، رهناً بتوافر ترتيبات لوجستية مناسبة، ما لم يعترض أيٌّ من الطرفين على ذلك.

69. In the reporting period, CAS made the logistical arrangements to facilitate the participation of Parties and observer organizations in ADP 2, parts 4 and 5, SBI 40 and SBSTA 40.

وينبغي أن يقدم المجتمع الدولي الدعم المالي والتقني إلى البلدان غير الساحلية وبلدان المرور العابر النامية من أجل تنفيذ الاتفاقيات والاتفاقات الدولية ذات الصلة بتيسير المرور العابر، وتأييد المبادرات التي تعزز التعاون في مجال النقل العابر وتحد من تكاليف النقل العابر وترسِّخ ترتيبات لوجستية تتسم بالسلاسة.
