The Court of Appeal has held that where a statutory provision cannot be given a meaning that is consistent with the New Zealand Bill of Rights Act 1990, a Court may issue a declaration of inconsistency despite the fact that the provision must be enforced.
وقد رأت محكمة الاستئناف أنه إذا تعذر إعطاء أي حكم قانوني معنى يتمشى مع قانون شرعة الحقوق في نيوزيلندا لعام 1990، يمكن لأي محكمة أن تصدر إعلاناً بعدم التوافق رغم لزوم إنفاذ الحكم().
