According to Articles 96 of the Charter and 65 of the Court's Statute, this tribunal can give an advisory opinion on any legal question, whether abstract or not.

Under article 138 of the rules of the Tribunal, the Tribunal may also be requested to give an advisory opinion on a legal question if an international agreement related to the purposes of the Convention specifically provides for the submission of a request for such an opinion.

The Committee decided, without a vote, that there was not a substantial basis for the application under article 11 of the statute of the Administrative Tribunal and therefore concluded that the International Court of Justice should not be requested to give an advisory opinion in respect of Judgement No. 630 delivered by the United Nations Administrative Tribunal in the case of Kofi against the Secretary-General of the United Nations.
١٢ - وقررت اللجنة، دون تصويت، عدم وجود أساس جوهري للطلب بموجب المادة ١١ من النظام اﻷساسي للمحكمة الادارية ولذلك فقد خلصت الى أنه ينبغي ألا يطلب الى محكمة العدل الدولية أن تصدر فتوى بصدد الحكم رقم ٦٣٠ الصادر عن المحكمة الادارية لﻷمم المتحدة في قضية كوفي ضد اﻷمين العام لﻷمم المتحدة.

On the other hand, if the General Assembly decides to request the Court to render an advisory opinion on the question set out in the draft resolution, it is important that the Court give its opinion without unnecessary delay.
