1. the conduct of an organ or agent of an international organization in the performance of functions of that organ or agent shall be considered as an act of that organization under international law whatever position the organ or agent holds in respect of the organization.
1- يُعتبر تصرف جهاز أو وكيل تابع لمنظمة دولية في تأدية مهامه فعلاً صادراً عن تلك المنظمة بمقتضى القانون الدولي، أيّاً كان المركز الذي يشغله ذلك الجهاز أو الوكيل في المنظمة.

the conduct of an organ or an agent of an international organization shall be considered an act of that organization under international law if the organ or agent acts in that capacity, even though the conduct exceeds the authority of that organ or agent or contravenes instructions.
يُعتبر تصرف جهاز أو وكيل تابع لمنظمة دولية فعلاً صادراً عن تلك المنظمة، بموجب القانون الدولي، إذا تصرف الجهاز أو الوكيل بهذه الصفة، وذلك حتى إذا تجاوز التصرف حدود سلطة ذلك الجهاز أو ذلك الوكيل أو كان مخالفاً للتعليمات.

“the conduct of an organ or agent of an insurrectional movement in the territory of a State or in any other territory under its jurisdiction shall not be considered as an act of that State if:
" لا يعتبر فعلا صادرا عن الدولة تصرف جهاز أو موظف تابع لحركة تمردية في إقليم هذه الدولة أو في أي مكان آخر خاضع لولايتها:

" 1. the conduct of an organ or agent of an international organization in the performance of functions of that organ or agent shall be considered as an act of that organization under international law whatever position the organ or agent holds in respect of the organization.
" 1 - يعتبر تصرف جهاز أو مسؤول تابع لمنظمة دولية في تأدية مهامه عملا صادرا عن تلك المنظمة بمقتضى القانون الدولي، أيا كان المركز الذي يشغله ذلك الجهاز أو المسؤول في المنظمة.

the conduct of an organ or agent of a State acting in that capacity which takes place in the territory of another State or in any other territory under its jurisdiction shall not be considered as an act of the latter State under international law.”
" ٢ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي ما يقع في إقليمها أو في أي إقليم آخر خاضع لولايتها من تصرف جهاز أو موظف تابع لدولة أخرى ويعمل بهذه الصفة " .

the conduct of an organ or agent of an international organization acting in that capacity shall not be considered as an act of a State under international law by reason only of the fact that such conduct has taken place in the territory of that State or in any other territory under its jurisdiction.”
" ٣ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف جهاز أو موظف تابع لمنظمة دولية، يعمل بهذه الصفة، لمجرد القيام بهذا التصرف في إقليم تلك الدولة أو في أي إقليم آخر خاضع لولايتها " .

There was support for considering the conduct of an organ or agent of an international organization in the performance of their functions to be deemed an act of that organization, as supported by the advisory opinion of the International Court of Justice on Reparation for Injuries Suffered in the Service of the United Nations.
وأعرب عن تأييد اعتبار تصرف جهاز أو مسؤول في منظمة في تأدية مهامه عملا صادرا عن تلك المنظمة، استنادا إلى فتوى محكمة العدل الدولية في قضية ' ' التعويض عن الأضرار المتكبدة في خدمة الأمم المتحدة``().

The conduct of an organ of a territorial governmental entity within a State [the conduct of an organ or agent of a federate State or of any territorial governmental entity acting in that capacity] shall also be considered as an act of that State under international law, provided that organ was acting in that capacity in the case in question.”
" ١ - يعتبر فعلا صادرا عن الدولة أيضا بمقتضى القانون الدولي تصرف أي جهاز تابع لكيان حكومي إقليمي داخل الدولة، شريطة أن يكون ذلك الجهاز قد تصرف بهذه الصفة في الحالة المعنية. ]تصرف جهاز أو موظف لولاية منضوية في اتحاد أو كيان حكومي إقليمي يتصرف بهذه الصفة[ " .
