" 8. Even though the Working Group, in its general comment on article 10 of the Declaration, has said that any detention that is unduly prolonged constitutes a violation of the Declaration, this does not mean that any short-term detention is permitted by the Declaration, since the Working Group immediately clarifies that a detention where the detainee is not charged so that he can be brought before a court, is a violation of the Declaration.

As highlighted by the Working Group in its general comment on enforced disappearance as a crime against humanity (A/HRC/13/31, para. 39), when there are claims of practices of enforced disappearances which may amount to crimes against humanity, the Working Group will evaluate these claims and, if appropriate, will refer them to the competent authorities, be they international, regional or domestic.
157- وعندما تُقدَّم ادعاءات فيما يتعلق بوجود ممارسات للاختفاء القسري قد تصل إلى درجة الجرائم ضد الإنسانية، يقوم الفريق العامل، كما أبرز في تعليقه العام بشأن الاختفاء القسري بوصفه جريمة ضد الإنسانية، (A/HRC/13/31، الفقرة 39)، بتقييم تلك الادعاءات وإحالتها، عند الاقتضاء، إلى السلطات المختصة سواءٌ كانت دولية أو إقليمية أو محلية.
