2. If the carrier, after reasonable effort, is unable to locate the controlling party or the controlling party is unable to provide adequate information, instructions or documents to the carrier, the shipper shall provide them.
2 - إذا تعذر على الناقل، بعد بذل جهد معقول، أن يحدد مكان الطرف المسيطر، أو تعذر على الطرف المسيطر تزويد الناقل بمعلومات أو تعليمات أو مستندات وافية، يقوم الشاحن بتوفيرها.

Draft article 59. Obligation to provide information, instructions or documents to carrier

- The title of the draft article should be examined for adjustment to differentiate it from that of draft article 30 by referring to " additional " information, instructions or documents and by removing the reference to " obligations " ;
- أن يُدرس تعديل عنوان مشروع هذه المادة بتمييزه عن عنوان مشروع المادة 30 وذلك بالإشارة إلى معلومات أو تعليمات أو مستندات " إضافية " أو بإزالة الإشارة إلى " الالتزامات " ؛

1. The controlling party, on request of the carrier or a performing party, shall provide in a timely manner information, instructions or documents relating to the goods not yet provided by the shipper and not otherwise reasonably available to the carrier that the carrier may reasonably need to perform its obligations under the contract of carriage.
1 - يوفر الطرف المسيطر في الوقت المناسب، بناء على طلب الناقل أو الطرف المنفذ، ما قد يعقل أن يحتاج إليه الناقل لأداء واجباته بمقتضى عقد النقل من معلومات أو تعليمات أو مستندات تتعلق بالبضاعة لم يكن الشاحن قد وفرها بعد وليست متاحة للناقل في حدود المعقول من مصدر آخر.

The Working Group was reminded that its most recent consideration of draft article 57 on the provision of additional information, instructions or documents to the carrier was at its seventeenth session (see A/CN.9/594, paras. 60 to 64).
108- ذُكِّر الفريق العامل بأن آخر مرة نظر فيها في مشروع المادة 57 المتعلقة بتزويد الناقل بمعلومات أو تعليمات أو مستندات إضافية كانت في دورته السابعة عشرة (انظر الوثيقة A/CN.9/594، الفقرات 60 إلى 64).

1. The controlling party, on request of the carrier or a performing party, shall provide in a timely manner information, instructions or documents relating to the goods not yet provided by the shipper and not otherwise reasonably available to the carrier that the carrier may reasonably need to perform its obligations under the contract of carriage.

If the carrier, after reasonable effort, is unable to identify and find the controlling party, or the controlling party is unable to provide adequate information, instructions, or documents to the carrier, the obligation to do so shall be on the shipper or the person referred to in article 7.7.
وإذا تعذر على الناقل، بعد بذل جهد معقول، التعرف على الطرف المسيطر والعثور عليه، أو تعذر على الطرف المسيطر تزويد الناقل بمعلومات أو تعليمات أو مستندات وافية، يقع الالتزام بفعل ذلك على عاتق الشاحن أو الشخص المشار إليه في المادة 7-7.

2. If the carrier, after reasonable effort, is unable to locate the controlling party or the controlling party is unable to provide adequate information, instructions, or documents to the carrier, the shipper shall provide them.
2- إذا تعذّر على الناقل، بعد بذل جهد معقول، أن يحدِّد مكان الطرف المسيطر، أو تعذّر على الطرف المسيطر تزويد الناقل بمعلومات أو تعليمات أو مستندات وافية، وجب على الشاحن تقديم تلك المعلومات أو التعليمات أو المستندات.

By way of further explanation, the Working Group heard that the intention of draft article 57 was to create a system whereby the carrier not only received instructions from the controlling party pursuant to draft articles 52 and 53, but that the carrier could also request information, instructions or documents from the controlling party further to draft article 57.
110- وبغية زيادة التوضيح، سمع الفريق العامل أن القصد من مشروع المادة 57 هو إنشاء نظام يستطيع الناقل بواسطته لا الحصول على تعليمات من الطرف المسيطر عملا بمشروعي المادتين 52 و53 فحسب، وإنما أيضا طلب معلومات أو تعليمات أو مستندات من الطرف المسيطر بمقتضى مشروع المادة 57.

(c) The draft article referred not only to information, but also to " instructions or documents " , not all of which might necessarily be available to the controlling party;
