64. His delegation noted that, under article 41, all States must cooperate to bring to an end through lawful means any serious breach within the meaning of article 40 and that no State should recognize as lawful a situation created by a serious breach within the meaning of article 40, nor render aid or assistance in maintaining that situation.

6. Paragraph 5 of the resolution states that the Member States shall not recognize as lawful the situation resulting from the occupation of the territories of the Republic of Azerbaijan, nor render aid or assistance in maintaining this situation.

The International Law Commission's articles on State responsibility for internationally wrongful acts, adopted in resolution 56/83 of 12 December 2001, mandate that " No State shall recognize as lawful a situation created by a serious breach [of a peremptory norm of general international law] " , which clearly includes the crime of genocide and crimes against humanity, " nor render aid or assistance in maintaining that situation " (article 41).
إن مواد لجنة القانون الدولي بشأن مسؤولية الدول عن الأفعال غير المشروعة دوليا، المعتمدة في القرار 56/83 المؤرخ 12 كانون الأول/ديسمبر 2001، تنص على أنه " لا تعترف أي دولة بشرعية وضع ناجم عن إخلال خطير ]بقاعدة قطعية من قواعد القانون الدولي العام[ " ، والتي تتضمن بوضوح جريمة الإبادة الجماعية والجرائم المرتكبة ضد الإنسانية، " ولا تقدم أي عون أو مساعدة للحفاظ على ذلك الوضع " (المادة 41).
