In this regard, the Special Rapporteur recalls article 12 of the Convention on the Rights of Child, which provides that States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.

However, article 12 expressly articulates States Parties' obligations to " assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child " .

56. The Committee recommends that the State party amend its legislation to fully reflect article 12 of the Convention so that any child " who is capable of forming his or her own views " can express those views freely, including in all administrative and judicial proceedings affecting them.
