The words " in knowledge of the facts " described the contrary situation, i.e. where the person issuing the communication was fully aware of every fact relating to the purchase at the time of formation of the contract.
وعبارة " عن علم بالوقائع " تصف الوضع المعاكس، أي الوضع الذي يكون فيه الشخص المصدر للخطاب على دراية تامة بكل الوقائع المتعلقة بالشراء في وقت تكوين العقد.

واستصوابا لحذف مشروع المادة 8 أيضا، قيل انه لا ينبغي القيام بأي محاولة لتوفير قاعدة بشأن وقت تكوين العقد تخالف مضمون اتفاقية الأمم المتحدة للبيع.

Equally strong support was expressed in favour of deletion of the draft paragraph on the assumption that no interference should be made with the general law applicable outside the draft instrument regarding the time of contract formation.
وأعرب عن تأييد بنفس القوة لحذف مشروع الفقرة 1، بافتراض أنه لا ينبغي التدخل في القانون العام المنطبق خارج نطاق مشروع الصك فيما يتعلق بوقت تكوين العقد.

If the purpose of the draft paragraph, it was said, was to facilitate a determination of the time of contract formation when data messages were used for that purpose, the issue was regarded as being adequately dealt with by draft article 11.
وقيل إنه اذا كان الغرض من مشروع الفقرة هو تيسير تحديد وقت تكوين العقد عندما تستخدم رسائل بيانات لذلك الغرض، فان المسألة تعتبر معالجة بصورة وافية في مشروع المادة 11.

Also in favour of deletion of draft article 8, it was stated that no attempt should be made to provide a rule on the time of contract formation that might be at variance with the rules on contract formation of the law applicable to any given contract.
وقيل أيضا، تأييدا لحذف مشروع المادة 8، إنه لا ينبغي بذل أي محاولة لتوفير قاعدة بشأن وقت تكوين العقد يمكن أن تختلف عما ينص عليه القانون الذي ينطبق على أي عقد معين من قواعد تكوين العقود.

Therefore, while a number of reasons may otherwise render a contract invalid under domestic law, the sole fact that automated message systems were used for purposes of contract formation will not deprive the contract of legal effectiveness, validity or enforceability.

Although some legal systems have general rules on the effectiveness of communications in a contractual context, in many legal systems general rules are derived from the specific rules that govern the effectiveness of offer and acceptance for purposes of contract formation.
ورغم أنّه توجد قواعد عامة في بعض النظم القانونية تحكم فعالية الخطابات في سياق التعاقد، فإنّ القواعد العامة في كثير من النظم القانونية تُستمد من القواعد المحدّدة التي تحكم فعالية العرض والقبول لأغراض تكوين العقد.

In this context it is worth pointing out that the 1980 Rome Convention on the law applicable to contractual obligations seeks to multiply the possibilities for validating the formation of a contract in order to avoid delaying tactics by parties fraudulently challenging the validity of a contract in order to evade its substantive obligations.
وفي هذا السياق تجدر الإشارة إلى أن اتفاقية روما لسنة 1980 المعنية بالقانون المنطبق على الالتزامات التعاقدية تسعى إلى مضاعفة إمكانيات إثبات صحة تكوين العقد بغية تجنّب مناورات التأخير من جانب أطراف يطعنون إحتياليا في صحة عقد من أجل الإفلات من التزاماته الموضوعية.

The courts did not deem the letter sent by the Russian organization to be an acceptance, since the wording did not confirm the formation of a contract under the conditions stated in the agreement of 6 September 2001.
ولم تعتبر المحاكم رسالة المؤسسة الروسية قبولا، لأنَّ الصياغة لم تؤكّد تكوين العقد بمقتضى الشروط المنصوص عليها في الاتفاق المؤرخ 6 أيلول/سبتمبر 2001.

However, the countervailing view, which gathered considerable support, was that it might be useful to include an additional qualification that made it clear that the communications referred to in the draft article might occur before or after the formation of a contract, such as " before, during or following an existing or contemplated contract " .
غير أن الرأي المخالف الذي حظي بقدر هام من التأييد ذهب إلى أنه قد يكون من المفيد إدراج شرط إضافي يوضّح أن البلاغات المشار إليها في مشروع المادة يمكن أن تحدث قبل تكوين العقد أو بعده، وذلك على غرار النص التالي مثلا: " قبل عقد موجود أو معتزم أو أثناءه أو بعده " .

With respect to the conditional delivery of the propane gas, the court held that, if delivery of the goods is made, after the formation of the contract, subject to a limitation of export destinations, such a limitation must be regarded as a violation of the duty of the seller under article 41 CISG.
وبخصوص التسليم المشروط لغاز البروبان ، قضت المحكمة أنه اذا أخضع تسليم السلع ، بعد تكوين العقد ، لقيود محددة على وجهات التصدير ، فينبغي اعتبار هذه القيود انتهاكا للواجب الواقع على البائع بموجب المادة ١٤ من اتفاقية البيع .

Also, in the penultimate sentence of paragraph 23, " Thereafter " would be replaced by " After the contract formation period " .
وسيستعاض أيضا، في الجملة قبل الأخيرة من الفقرة 23، عن عبارة " بعد ذلك " بعبارة " بعد فترة تكوين العقد " .
