If a State Party that makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may consider this Convention the legal basis for extradition in respect of any offence to which this article applies.
4- اذا تلقت دولة طرف، تجعل تسليم المجرمين مشروطا بوجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة لتسليم المجرمين، جاز لها أن تعتبر هذه الاتفاقية هي الأساس القانوني للتسليم فيما يتعلق بأي جرم تنطبق عليه هذه المادة.

5. If a State Party that makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may consider this Convention the legal basis for extradition in respect of any offence to which this article applies.
5- إذا تلقت دولة طرف، تجعل تسليم المجرمين مشروطا بوجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، جاز لها أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم فيما يخص أي جرم تنطبق عليه هذه المادة.

11. A State Party in whose territory an alleged offender is found, if it does not extradite such person in respect of an offence to which this article applies solely on the ground that he or she is one of its nationals, shall, at the request of the State Party seeking extradition, be obliged to submit the case without undue delay to its competent authorities for the purpose of prosecution.
11- إذا لم تقم الدولة الطرف التي يوجد الجاني المزعوم في إقليمها بتسليم ذلك الشخص فيما يتعلق بُجرم تنطبق عليه هذه المادة لمجرد كونه أحد مواطنيها، وجب عليها القيام، بناء على طلب الدولة الطرف التي تطلب التسليم، بإحالة القضية دون إبطاء لا مسوّغ لـه إلى سلطاتها المختصة بقصد الملاحقة.

11. A State Party in whose territory an alleged offender is found, if it does not extradite such person in respect of an offence to which this article applies solely on the ground that he or she is one of its nationals, shall, at the request of the State Party seeking extradition, be obliged to submit the case without undue delay to its competent authorities for the purpose of prosecution.
11- إذا لم تقم الدولة الطرف التي يوجد الجاني المزعوم في إقليمها بتسليم ذلك الشخص فيما يتعلق بجرم تنطبق عليه هذه المادة لمجرد كونه أحد مواطنيها، وجب عليها القيام، بناء على طلب الدولة الطرف التي تطلب التسليم، بإحالة القضية دون إبطاء لا مسوّغ لـه إلى سلطاتها المختصة بقصد الملاحقة.
