The Organization of the Judiciary Act No. 23 of 1990 includes a number of legal provisions in connection with the judiciary that seek to strengthen the principle of the independence of the judiciary.

The Organization of the Judiciary Act No. 23 of 1990 regulates the various levels of courts, defines the composition and powers of the Higher Council of the Judiciary, regulates judicial appointments and promotions and specifies the duties of judges and the composition and jurisdiction of the Department of Public Prosecutions.

90. Title X of the Constitution of 17 December 1962, entitled " Justice " , establishes the principles underpinning the Organization of the Judiciary.

Article 5 of the Judiciary Organization Act states: " The magistrates and judges, when hearing and deciding cases, shall apply the State Constitution in preference to the laws and the laws in preference to any other provisions.
وتنص المادة ٥ من قانون تنظيم القضاء على ما يلي: " على القضاة والحكام، عند نظرهم وفصلهم في القضايا، أن يطبقوا دستور الدولة قبل القوانين وأن يطبقوا القوانين قبل أية أحكام أخرى.

CEJ says that the Judicial Organization Code needs a complete overhaul to modernize the jurisdiction, structure and auxiliary offices of the courts.

The Committee urges the State party to amend its Military Criminal Code, Code of Military Criminal Procedure and the Military Justice Organization Act in order to establish that military courts do not have jurisdiction over cases involving human rights violations, including acts of torture and ill-treatment committed by members of the armed forces.

9- تحيط اللجنة علماً بالبيان الوارد في الردود على قائمة المسائل والذي يفيد بأن التشريعات الكويتية تكفل عدة أنواع من المراقبة والإشراف على السجون، وفقاً لقانون تنظيم القضاء (23/1990)، والقانون رقم 26 لسنة 1962، والمادة 56 من مرسوم القانون رقم 23 لسنة 1990.
