The actions undertaken by the anti-constitutional authorities from Tiraspol are in a flagrant contradiction with the provisions of Article 10 of the Universal Declaration of Human Rights, stating that " Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him " .

19. The Working Group further considers that insofar as Tariq Aziz is currently subjected to " the determination of a criminal charge against him " (article 14 (1) ICCPR), irrespective of whether the trial against him has begun or not, he is entitled to the minimum guarantees afforded by article 14 (3) ICCPR.
