245. Attention may also be drawn to the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment, annexed to General Assembly resolution 43/173, of 9 December 1988, especially Principle 8 concerning detention pending deportation.
245 - ويجدر توجيه الاهتمام أيضا إلى مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الخاضعين لأي شكل من أشكال الاحتجاز أو السجن، المرفقة بقرار الجمعية العامة للأمم المتحدة 43/173، المؤرخ 9 كانون الأول/ديسمبر 1988، وبخاصة المبدأ 8 المتعلق بمسألة الاحتجاز رهن الطرد.

Relying on the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment and on the right to be free from arbitrary arrest and imprisonment as enshrined in International Conventions, the Trial Chamber held that " the act of unlawful arrest means to apprehend a person, without due process of law " .
