Mr. Castello (United States of America) said that the original reference to article 26, paragraph 9, contained in draft article 17, paragraph 4, had been intended to allow for an exception to the requirement that all communications to the arbitral tribunal by one party must at the same time be communicated by that party to all other parties.

7. Mr. Holguín González (Mexico) drew attention to his Government's proposal, contained in document A/CN.9/704/Add.6, that the rule set out in paragraph 4 should govern all communications relating to arbitration proceedings and should be set out in a new paragraph under article 2.
