7. The provisions of subparagraph (a) require all suppliers or contractors parties to the framework agreement to be invited to participate or, where relevant, only those " capable " of fulfilling the procuring entity's requirements.

The Working Group recalled its consideration of this subject at its ninth session (A/CN.9/595, paras. 23-38), and in particular the reference to the preamble of the Model Law, which provided for the fair and equitable treatment of all suppliers and contractors.

The Working Group's understanding was that the Model Law should list only those requirements for the content of the solicitation documents in procurements conducted by way of ERAs that were crucial for the proper handling of ERAs and for the fair and equitable treatment of all suppliers and contractors.

(11) Following completion of negotiations, the procuring entity shall request all suppliers or contractors remaining in the proceedings to submit, by a specified date, a best and final offer with respect to all aspects of their proposals.
(11) تطلب الجهة المشترية، بعد إتمام المفاوضات، إلى جميع المورّدين أو المقاولين الباقين في الإجراءات أن يقدِّموا، في تاريخ معيّن، أفضل عرض نهائي لديهم فيما يتعلق بجميع جوانب اقتراحاتهم.

" (13) Following the negotiations, the procuring entity must request all suppliers or contractors with whom it has negotiated to submit a best and final offer in respect of the solutions or solution identified through the dialogue process.

(b) It was recalled that the 1994 Model Procurement Law permitted procuring entities to call for the legalization of documents from all suppliers, which could be time consuming and expensive for suppliers.

" (2) The procuring entity shall promptly notify all suppliers or contractors whose tenders or other submissions were evaluated of its intended decision to accept the successful tender or submission.

Mr. Yukins (United States of America) said that the ideal would be for all suppliers or contractors party to a framework agreement to receive a written invitation.
33- السيد يوكينـز (الولايات المتحدة الأمريكية): قال إنَّ الوضع المثالي هو أن يتلقّى جميع المورّدين أو المقاولين الأطراف في اتفاق إطاري دعوة كتابية.

The Working Group at the current session underscored that the root of the issue was this performance risk and in addition noted that ALTs might compromise the aims of the Model Law, including economy and efficiency in procurement, the promotion of competition among suppliers and contractors, and the fair and equitable treatment of all suppliers and contractors.
وشدّد الفريق العامل في الدورة الحالية على أن جوهر المسألة هو هذه المخاطرة في التنفيذ، كما لاحظ أن العطاءات المنخفضة الأسعار انخفاضا غير عادي قد تخل بمقاصد القانون النموذجي، بما فيها الوفر والكفاءة في عملية الاشتراء، وتعزيز التنافس فيما بين المورّدين والمقاولين، ومعاملة جميع المورّدين والمقاولين معاملة منصفة ومتكافئة.

(6) Any modification or clarification of the request for proposals, including modification of the criteria for evaluating proposals referred to in paragraph (3) of this article, shall be communicated to all suppliers or contractors participating in the request-for-proposals proceedings.
