(a) The situation of distress is due, either alone or in combination with other factors, to the conduct of the organization invoking it; or
(أ) إذا كانت حالة الشدة تعزى، منفردة أو بالاقتران مع عوامل أخرى، إلى تصرف المنظمة التي تستظهر بها؛ أو

(أ) إذا كانت حالة الشدة ناجمة، إما وحدها أو بالاقتران مع عوامل أخرى، عن تصرف الدولة التي تتذرع به؛

4 - ولا تنطبق المادة 24 المتعلقة بمسؤولية الدول عن الأفعال غير المشروعة دولياً إلا عندما لا تكون حالة الشدة ناشئة عن تصرف الدولة التي تحتج بها ولا يكون من المحتمل أن يؤدي الفعل المعني إلى حدوث خطر مماثل أو أكبر.

1. The wrongfulness of an act of a State not in conformity with an international obligation of that State is precluded if the author of the act in question had no other reasonable way, in a situation of distress, of saving the author's life or the lives of other persons entrusted to the author's care.
حالة الشدة 1- تنتفي صفة عدم المشروعية عن فعل الدولة غير المطابق لالتزام دولي لتلك الدولة إذا لم تكن لدى الشخص الذي قام بالفعل المذكور، وهو في حالة شدة، وسيلة معقولة أخرى لإنقاذ حياته أو حياة الأشخاص الآخرين الموكلة إليه رعايتهم.
