اقتراح بمعالجة بعض الأوضاع المتعلقة بتفقّد البضاعة الموجودة في حاوية مغلقة أو العلم الفعلي بمحتوياتها

It was further noted that paragraph 3 addressed the context of goods delivered for shipment in a non-closed container, whereas paragraph 4 addressed goods delivered in a closed container.
ولوحظ كذلك أن الفقرة 3 تتناول سياق البضاعة المسلّمة للشحن في حاوية غير مغلقة، بينما تتناول الفقرة 4 البضاعة المسلّمة في حاوية مغلقة.

Since a carrier was unable to check the contents inside a closed container, without adequate information from the shipper about the nature of the contents the carrier could not transport the goods safely.
ولما كان الناقل يعجز عن مراقبة المحتويات داخل حاوية مغلقة دون توافر معلومات كافية من الشاحن عن طبيعة المحتويات فإن الناقل لا يستطيع نقل البضائع بأمان.

4. When the goods are delivered for carriage to the carrier or a performing party in a closed container, the carrier may qualify the information referred to in:

Therefore, it was suggested that a more appropriate and efficient way of addressing that situation was to add the phrase " or are delivered in a closed container but the carrier or the performing party has in fact inspected the goods " after the phrase " in a closed container " in the chapeau of paragraph 3.
ولذلك قيل إن هناك طريقة أنسب وأنجع لمعالجة هذا الوضع وهي إضافة العبارة " أو تسلَّم في حاوية مغلقة ولكن الناقل أو الطرف المنفذ قد تفقّد البضاعة فعلا " بعد العبارة " في حاوية مغلقة " الواردة في فاتحة الفقرة 3.

3. When the goods are not delivered for carriage to the carrier or a performing party in a closed container, or when they are delivered in a closed container and the carrier or a performing party actually inspects them, the carrier may qualify the information referred to in article 38, paragraph 1, if:

Under subparagraph 8.2.2 (b), however, if the carrier or a performing party actually carried out a more thorough inspection (e.g. inspecting the contents of packages or opening a closed container), then the carrier was responsible for whatever such an inspection should have revealed (see A/CN.9/WG.III/WP.21, paras. 135-136).

In that connection, the view was expressed that draft article 42 left a possible gap, namely, in situations where the goods were delivered in a closed container but the carrier had actually inspected them, albeit not fully, for example when the carrier opened a container to ascertain that it indeed contained the goods declared by the shipper but was not able to verify their quantity.
136- وفي هذا الصدد، أعرب عن رأي مفاده أن مشروع المادة 42 ربما يترك فجوة، وهي عندما تكون البضاعة قد سُلّمت في حاوية مغلقة ولكن الناقل تفقّدها فعلا، وإن لم يكن تفقّدا كاملا، وذلك مثلا عندما يكون الناقل قد فتح إحدى الحاويات للتأكد من أنها تحتوي فعلا على البضاعة التي أعلنها الشاحن، ولكن لم يتمكن من التحقق من كميتها.
