The author challenged in court the legal definition of his actions, since, inter alia, he did not display any flags and the commemoration took place in woodland and not in a public place.
واعترض صاحب البلاغ أمام المحكمة على التعريف القانوني لأعماله لأسباب من ضمنها عدم إبرازه أي رايات وعدم تنظيم حفل إحياء الذكرى في مكان عام بل في منطقة حرجية.

3.1 The author submits that his detention by the police on 30 October 2007 in the course of the commemoration interfered with his right to freedom of expression, as guaranteed by article 19, paragraph 2, of the Covenant.
3-1 يدعي صاحب البلاغ أن احتجازه من جانب الشرطة في 30 تشرين الأول/ أكتوبر 2007 خلال حفل إحياء الذكرى يشكل انتهاكاً لحقه في حرية التعبير المكفول بموجب الفقرة 2 من المادة 19 من العهد.

5.4 The author submits that by breaking up the commemoration, the State party's authorities also deprived him of the right to freedom of expression.
5-4 ويدعي صاحب البلاغ أن سلطات الدولة الطرف حرمته أيضاً من الحق في حرية التعبير بفض حفل إحياء الذكرى.

Consequently, the police officers' demand that the commemoration be stopped was not aimed at suppressing the author's unlawful actions but rather at depriving him of the right to peaceful assembly and the right to freedom of expression.
فطلب ضباط الشرطة وقف حفل إحياء الذكرى لم يكن يهدف إلى كبح أعمال صاحب البلاغ غير المشروعة، بل إلى حرمانه بالأحرى من الحق في التجمع السلمي والحق في حرية التعبير.

Lastly, the author claimed that the commemoration in which he took part was a peaceful citizens' gathering. They did not pose a threat to national security, public safety, public order, the protection of public health, morals or rights and freedoms of others.
وأخيراً، ادعى صاحب البلاغ أن حفل إحياء الذكرى الذي شارك فيه كان عبارة عن تجمع سلمي للمواطنين الذين لم يهددوا الأمن الوطني أو السلامة العامة أو النظام العام أو حماية الصحة العامة أو الأخلاق العامة أو حماية حقوق الآخرين وحرياتهم.

7.2 The author states that the commemoration took place in woodland where the execution of the victims of political repression was carried out and not at the parking lot or on the motorway.
7-2 ويذكر صاحب البلاغ أن حفل إحياء الذكرى نظم في منطقة حرجية تم فيها إعدام ضحايا القمع السياسي وليس في موقف السيارات أو على طريق السيارات السريعة.

11.3 The first issue before the Committee is whether or not the application of article 23.34, part 3, of the Code on Administrative Offences to the author's case, resulting in the termination of the commemoration and the subsequent fine, constituted a restriction within the meaning of article 19, paragraph 3, on the author's right to freedom of expression.
