وتخلص اللجنة الى أن حق السيد هارفارد في محاكمة عادلة، في الظروف الخاصة للقضية، وبتحديد أشد، حقه في الحصول على ما يكفي من تسهيلات ﻹعداد دفاعه، لم ينتهك.

26. 26- ينبغي أن ينص القانون على أنّ الحق الضماني في حق الحصول على سداد الأموال المودعة في حساب مصرفي يكون نافذا بصرف النظر عن أي اتفاق بين المانح والمصرف الوديع يقيّد بأي شكل من الأشكال حق المانح في إنشاء حق ضماني في حقه في الحصول على سداد الأموال المودعة في الحساب المصرفي.
