3.4 The author submits that his rights under article 14, paragraph 1, were violated, since he was denied a fair trial in the determination of the criminal charges against him.
3-4 ويقول صاحب البلاغ إن حقوقه التي تكفلها الفقرة 1 من المادة 14 قد انتهكت لأنه حرم من محاكمة عادلة لدى الفصل في التهم الجنائية الموجهة ضده.

The Committee therefore declares the communication admissible ratione materiae insofar as the author claims to be a victim of violations of his rights under article 14, paragraph 1.

12. The Human Rights Committee, acting under article 5, paragraph 4, of the Optional Protocol to the International Covenant on Civil and Political Rights, is of the view that the author's removal to the Islamic Republic of Iran would violate his rights under articles 6, paragraph 1, and article 7 of the Covenant.
12- وترى اللجنة، إذ تتصرف وفقاً للفقرة 4 من المادة 5 من البروتوكول الاختياري الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية، أن إبعاد صاحب البلاغ إلى جمهورية إيران الإسلامية من شأنه أن ينتهك حقوقه التي تكفلها الفقرة 1 من المادة 6 والمادة 7 من العهد.

9.4 With regard to the author's claim that his rights under article 14 of the Covenant were violated, the Committee recalls that the right to a fair and public hearing by a competent, independent and impartial tribunal is guaranteed in cases regarding the determination of criminal charges against individuals or of their rights and obligations in a suit at law.
9-4 وعن ادعاء صاحب البلاغ أن حقوقه التي تكفلها المادة 14 من العهد انتهكت، تذكّر اللجنة بأن الحق في محاكمة عادلة وعلنية أمام محكمة مختصة ومستقلة ونزيهة مضمون في القضايا المتعلقة بالبت في التهم الجنائية في حق الأفراد أو حقوقهم والتزاماتهم في دعوى مدنية.
