16. The Human Rights Committee, acting under article 5, paragraph 4, of the Optional Protocol to the International Covenant on Civil and Political Rights, is of the view that the facts before it disclose a violation of the rights of the authors under article 25 (b) of the Covenant.
16- وإن اللجنة المعنية بحقوق الإنسان، إذ تتصرف بمقتضى الفقرة 4 من المادة 5 من البروتوكول الاختياري الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية ترى أن الوقائع المعروضة أمامها تكشف عن انتهاك حقوق أصحاب البلاغ بموجب المادة 25(ب) من العهد.

The authors' removal to Sri Lanka would, if implemented, violate their rights under article 7 of the Covenant.
انتهاك حقوق أصحاب البلاغ بموجب المادة 7 من العهد في حال تنفيذ إبعادهم إلى سري لانكا.

In this regard, the Committee notes that the national authorities have not explained how the restrictions imposed on the authors' rights under article 19 of the Covenant were justified under article 19, paragraph 3, of the Covenant.

Furthermore, the national authorities had not explained how the restrictions imposed on the authors' rights under article 19 of the Covenant were justified under article 19, paragraph 3, of the Covenant.

In the absence of any argument adduced by the State party to refute that claim, the Committee finds that the authors' rights under article 12, paragraph 1, of the Covenant were violated.

3.6 Third, it should be noted that contrary to the two Länsman cases, the Supreme Court in the " Aursunden Case 1997 " , dismissed the appeal without discussing the authors' rights under article 27 of the Covenant.
٣-٦ ولذلك يجدر بالذكر أنه على خلاف قضيتي لانزمان قامت المحكمة العليا في " قضية أورسوندن لعام ١997 " برفض الطعن دون مناقشة حقوق أصحاب البلاغ بموجب المادة ٢7 من العهد.

In the present case, the slaughter of all their reindeer constitutes a particularly grave interference with the authors' rights under the Covenant, since it would deprive them of their livelihood which is essential for their ability to continue to enjoy their traditional culture.
وفي هذه القضية، يشكل ذبح جميع أيائل الرنة الخاصة بأصحاب البلاغ تدخلاً سافراً بصفة خاصة في حقوق أصحاب البلاغ بموجب العهد، لأنه سيحرمهم من سبل عيشهم الأساسية لتمكنهم من مواصلة تمتعهم بثقافتهم التقليدية.

In the circumstances, and in the absence of any information in this regard from the State party to justify the restriction for purposes of article 19, paragraph 3, of the Covenant, the Committee concludes that the authors' rights under article 19, paragraph 2, of the Covenant have been violated.

In a case before it, the Human Rights Committee found that the author's rights under article 17, in conjunction with article 2(1) and (2) did not receive effective protection.
