While the protection of the rights and reputation of others and the protection of national security are certainly legitimate aims, the real challenge is, to a greater extent, to protect and to promote freedom of expression without creating additional barriers.
ولئن كانت حماية حقوق الآخرين وسمعتهم وحماية الأمن القومي هدفين مشروعين بالتأكيد، فإن التحدي الحقيقي يتمثل، بدرجة أكبر، في حماية وتعزيز حرية التعبير دون خلق حواجز إضافية.

Freedom of expression may be restricted by the law if necessary to protect rights and reputation of others, to uphold the authority and objectivity of the court and to protect public health, morals of a democratic society and national security of the Republic of Serbia.

57. As regards the inter-American human rights protection system, the American Convention on Human Rights recognizes in article 13 limitations relating to respect for the rights or reputations of others.
57- وفيمـا يخص نظام حماية حقوق الإنسان للبلدان الأمريكية، فإن الاتفاقية الأمريكية لحقوق الإنسان تنص في المادة 13 على قيود متصلة باحترام حقوق الآخرين وسمعتهم.

2.5 The author maintains that her actions were wrongly defined as a picket; in the absence of any well-founded explanations justifying the court's conclusion, the penalty imposed on her cannot be justified by the need to protect national security or public order, public health or morals, or for respect of the rights and reputations of others.
2-5 وتؤكد صاحبة البلاغ أن أفعالها قد حُددت خطأً على أنها اعتصام؛ مع عدم وجود أي تفسيرات ذات أساس جيد تبرر الاستنتاج الذي خلصت إليه المحكمة، كما لا يمكن تبرير العقوبة الموقعة عليها بالحاجة إلى حماية الأمن القومي أو النظام العام أو الصحة العامة أو الآداب العامة أو إلى احترام حقوق الآخرين وسمعتهم.

(n) To review their procedures, practices and legislation, as necessary, to ensure that any limitations on the right to freedom of opinion and expression are only such as are provided by law and are necessary for the respect of the rights and reputations of others, or for the protection of national security or of public order (ordre public) or of public health or morals;

3.6 On the second condition, it is argued that the latitude afforded to the judiciary regarding its powers of contempt under Sri Lankan law, and the extent to which they operate as a restriction on the right to freedom of expression, are not sufficiently closely related to the aims specified in article 19, namely the protection of " public order " and " the rights and reputation of others " .
3-6 وفيما يخص الشرط الثاني، يقول صاحب البلاغ إن اتساع الصلاحيات الممنوحة للسلطة القضائية للمعاقبة على انتهاك حرمة المحكمة بموجب القانون السريلانكي ومدى استعمال هذه الصلاحيات لتقييد الحق في حرية التعبير لا تربطهما صلة وثيقة بما فيه الكفاية بالأهداف المحددة في المادة 19، ألا وهي حماية " النظام العام " و " حقوق الآخرين وسمعتهم " .

The courts' decisions are lawful and are in full compliance with article 19, paragraph 3, of the Covenant, according to which the right to freedom of expression may be subject to certain restrictions as are provided by law and are necessary for respect of the rights or reputations of others.
ويعد قرارا المحكمتين قانونيين ومطابقين تماماً لأحكام الفقرة 3 من المادة 19 من العهد، حيث يجوز إخضاع الحق في حرية التعبير إلى بعض القيود على النحو المنصوص عليه في القانون ووفقاً لما يقتضيه احترام حقوق الآخرين وسمعتهم.
