" يعتبر الشخص ' ضحية ' عندما يصيبه فردياً أو جماعياً من جراء فعل أو تقصير يشكل انتهاكاً لقواعد حقوق الإنسان الدولية أو قواعد القانون الإنساني الدولي، ضرر منه الضرر البدني أو الذهني، أو المعاناة العاطفية أو الخسارة الاقتصادية، أو الحرمان من حقوقه القانونية الأساسية.

As stated in the preamble to Commission on Human Rights resolution 1999/34 of 26 April 1999 on impunity, " the practice and expectation of impunity for violations of international human rights or humanitarian law encourage such violations " and are among the fundamental obstacles to the observance of those rights.
وكما جاء في ديباجة قرار لجنة حقوق الإنسان 1999/34 المؤرخ 26 نيسان/أبريل 1999 بشأن الإفلات من العقاب، إن " ممارسة وتوقع الإفلات من العقاب على انتهاكات حقوق الإنسان الدولية أو القانون الإنساني يشجعان على مثل هذه الانتهاكات " وهما من العراقيل الأساسية التي تعترض مراعاة تلك الحقوق.

8- يعتبر الشخص " ضحية " عندما يصيبه فردياً أو جماعياً، جراء فعل أو تقصير يشكل انتهاكاً لقواعد حقوق الإنسان الدولية أو قواعد القانون الإنساني الدولي، ضرر منه الضرر البدني أو الذهني، أو المعاناة العاطفية، أو الخسارة الاقتصادية، أو الحرمان من حقوقه القانونية الأساسية.

(c) Make available all appropriate diplomatic and legal means to ensure that victims can exercise their rights to a remedy and reparation for violations of international human rights or humanitarian law.

11. The Basic Principles provide that " adequate, effective and prompt reparation shall be intended to promote justice by redressing violations of international human rights or humanitarian law " and " should be proportional to the gravity of the violations and the harm suffered " .

The majority of current sanctions regimes of the United Nations include, as part of their justification, violations of international human rights or humanitarian law, or make explicit reference to particular violations, such as recruiting child soldiers, committing rape and gender-based violence, targeting civilians and other similar offences.

IDPs who have been victims of violations of international human rights or humanitarian law, including arbitrary displacement must have full and non-discriminatory access to effective remedies and access to justice, including, where appropriate, access to existing transitional justice mechanisms, reparations and information on the causes of violations.
