The judge who heard the third case ruled that, since the first two suits had not been examined on the merits, the author was entitled to bring the third action and that it was not an abuse of legal process, as the respondents had claimed.
واعتبر القاضي الذي استمع إلى الدعوى الثالثة أن من حق صاحبة البلاغ أن ترفع دعوى ثالثة ما دام القضاء لم ينظر في الأسس الموضوعية للدعويين الأولى والثانية، وأن هذه الدعوى الثالثة لا تشكل إساءة استخدام للإجراءات القانونية خلافاً لما ذهب إليه المدعى عليهم.

In these circumstances, the Committee concludes that in the present case the State party has violated the author's right under article 21 of the Covenant.
