(a) Arms embargo and ban on related brokering services

brokering services are controlled, when they are provided from Estonia to a foreign country or to a foreign recipient of services, regardless of the residence of the service provider, who is a natural person, or the location of the service provider, who is a legal person, or through the business activity of an Estonian service provider in a foreign country.

The Amendments to the Law on Export of Dual-Use Items refer to the regulation of the transit of dual-use items, the provision of brokering services and technical assistance associated with dual-use items and the prescription of penalties for offenders of the Act when national or foreign political interests of the Republic of Croatia are at risk.

As to paragraphs 8 and 9 of the resolution, Belgium has the following national legislation prohibiting the sale, supply, transfer or export of arms and related materiel to Iran and the provision of brokering services and other services related to military activities:

In July 2004, the Law on Export of Dual-Use Items was adopted, and in July 2008, the Croatian Parliament adopted Amendments to the Law, which refer to the regulation of the transit of dual-use items, the provision of brokering services and technical assistance associated with dual-use items and prescription of penalties for offenders of the Law when national or foreign political interests of the Republic of Croatia are at risk.

Denmark has the following national legislation requiring an authorization for the export of arms and related materiel to other countries than Denmark and an authorization for the provision of brokering services, which, together with Council Decision 2011/137/CFSP, provides the basis for enforcement of the arms embargo against Libya and the ban on related brokering services:

The national legislation, together with Council Common Position 2006/795/CFSP as amended by Council Common Position 2009/573/CFSP of 27 July 2009 and Council Regulation (EC) No. 329/2007 as amended, provide the basis for enforcement of the arms embargo against the DPRK and the ban on related brokering services.

The Czech Republic has adopted Act No. 69/2006 Coll. requiring an export authorization for the sale, supply, transfer or export of arms and related materiel to third countries and an authorization for the provision of brokering services and other services related to military activities which together with Council decision 2010/413/CFSP provides the basis for enforcement of the arms embargo against Iran and the ban on related brokering services.
