وشددت المحكمة، في فتواها، على أنه وفقاً لما تنص عليه الفقرة 6 من المادة 49 من اتفاقية جنيف الرابعة، فإن المستوطنات الإسرائيلية في الأرض الفلسطينية المحتلة قد " أقيمت خرقاً للقانون الدولي " (الفقرة 120).

The Court found that " the Israeli settlements in the Occupied Palestinian Territory (including East Jerusalem) have been established in breach of international law " , and that " the route chosen for the wall gives expression in loco to the illegal measures taken by Israel with regard to Jerusalem and the settlements " (paras. 120 and 122).
فقد خلصت المحكمة إلى أن " إقامة المستوطنات الإسرائيلية في الأرض الفلسطينية المحتلة (بما فيها القدس الشرقية) تشكل خرقاً للقانون الدولي " ، وأن " المسار المختار للجدار يعبر تعبيراً محلياً عن التدابير غير المشروعة التي تتخذها إسرائيل في ما يتعلق بالقدس والمستوطنات " (الفقرتان 120 و122).

Recalling the advisory opinion rendered on 9 July 2004 by the International Court of Justice on the Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory, and its conclusion that " the Israeli settlements in the Occupied Palestinian Territory (including East Jerusalem) have been established in breach of international law " ,
وإذ يشير إلى الفتوى التي أصدرتها محكمة العدل الدولية في 9 تموز/يوليه 2004 بشأن الآثار القانونية الناشئة عن تشييد جدار في الأرض الفلسطينية المحتلة، وإلى ما خلصت إليه من أن " إقامة المستوطنات الإسرائيلية في الأرض الفلسطينية المحتلة (بما فيها القدس الشرقية) تمثل خرقاً للقانون الدولي " ،

While the forms of prejudice varied widely, the ugliest kind of discrimination was imposed on peoples living under foreign occupation, which involved exploitation of their resources, expulsion from their lands and imposition of illegitimate authority, in contravention of international law and international humanitarian law.
وبينما تتعدد أشكال التحيز بدرجة كبيرة، إلا أن أبشع أنواع التمييز هي تلك التي تتعرّض لها الشعوب الواقعة تحت الاحتلال الأجنبي، والتي تشمل استغلال مواردها، وإجبار السكان على مغادرة أراضيهم والواقعة تحت سيطرة غير مشروعة، الأمر الذي يعد خرقاً للقانون الدولي والقانون الإنساني الدولي.
