The obligation for prevention extends to taking appropriate measures to identify activities creating a risk of causing significant transboundary harm.

65. Of the articles approved by the Commission during its forty-sixth session, article 1 was described as probably the most important, inasmuch as it made it clear that the draft articles applied only to activities which involved a risk of causing significant transboundary harm.
٦٤ - ووصفت المادة ١ بأنها ربما تكون أهم مادة من المواد التي اعتمدتها اللجنة في دورتها السادسة والأربعين، من حيث أنها توضح أن مشروع المواد لا ينطبق إلا على الأنشطة التي تنطوي على خطر إحداث ضرر جسيم عابر للحدود.

66. It was also noted that the application of the articles depended on, inter alia, the existence of activities involving a risk of causing significant transboundary harm through their physical consequences as defined in article 1, and that, therefore, the determination of the existence of such a risk was of crucial importance.

76. Article 20, specifying or enumerating the factors involved in an equitable balance of interests, was considered to be of practical assistance to States involved in activities with a risk of causing transboundary harm.
٧٥ - أما المادة ٢٠، التي تحدد أو تعدد العوامل التي تدخل في التوازن العادل للمصالح، فقد اعتبر أنها تنطوي على مساعدة عملية للدول التي تزاول أنشطة تنطوي على خطر إحداث ضرر عابر للحدود.

It was also suggested that in order to enable the innocent victims of activities involving a risk of causing significant transboundary harm to receive full compensation for the harm sustained, consideration should be given to a system of subsidiary liability of the State of origin aimed at covering that portion of the damage that was not reimbursed by the operator.

(25) Paragraph (d) defines hazardous activity by reference to any activity, which has a risk of causing transboundary harm through physical consequences.

34. As to whether the scope of the draft articles should be expanded, the view was also expressed that the main point was that the injured parties must be able to obtain compensation or other relief, regardless of whether the activity had involved a risk of causing harm.
٣٤ - أما فيما يتعلق بمسألة ما إذا كان ينبغي توسيع نطاق مشروع المواد، فقد ذهب رأي أيضا إلى أن النقطة اﻷساسية هي أن اﻷطراف المضرورة يتعين أن تكون قادرة على الحصول على تعويض أو غير ذلك من وسائل الجبر، بغض النظر عما إذا كان النشاط منطويا على خطر إحداث ضرر.

On the other hand, as was pointed out in paragraph (8) of the commentary to article 19, a situation might be envisaged where the State of origin might have honestly believed that the activity posed no risk of causing significant transboundary harm.

74. With reference to articles 18 and 20, it was noted that the States concerned were under an obligation to enter into consultations based on an equitable balance of interests with a view to achieving acceptable solutions regarding measures to be adopted in order to prevent or minimize the risk of causing significant transboundary harm.
٧٣ - ولوحظ بصدد المادتين ١٨ و ٢٠ أن الدول المعنية يقع عليها التزام بالدخول في مشاورات على أساس التوازن العادل للمصالح بغية تحقيق حلول مقبولة بشأن التدابير الواجب اتخاذها من أجل منع خطر إحداث ضرر جسيم عابر للحدود أو التقليل منه إلى أدنى حد.

According to another representative, the expression " risk of causing significant transboundary harm " seemed somewhat tautologous and ought to be replaced by the definition of the term " significant " contained in paragraph (4) of the commentary, which was greatly preferable.
وذهب ممثل آخر إلى أن التعبير " خطر إحداث ضرر جسيم عابر للحدود " يبدو أنه ينطوي على شيء من التكرار وأنه ينبغي الاستعاضة عنه بالتعريف الوارد لمصطلح " جسيم " في الفقرة )٤( من التعليق، وهو تعريف أفضل كثيرا.

It has a particular meaning, which is well understood as containing four elements, namely (a) such activities are not prohibited by international law; (b) such activities involve a risk of causing significant harm; (c) such harm must be transboundary; and (d) the transboundary harm must be caused by such activities through their physical consequences.
وهي تحمل معنى محدداً يفهم منه تماماً أنه يتضمن أربعة عناصر هي: (أ) القانون الدولي لا يحظر هذه الأنشطة؛ (ب) وتنطوي هذه الأنشطة على خطر إحداث ضرر ذي شأن؛ (ج) ولا بد أن يكون هذا الضرر عابراً للحدود؛ (د) ولا بد للضرر العابر للحدود من أن يكون ناشئاً عن هذه الأنشطة من خلال نتائجها المادية().
