٥٤ - أعرب عن التأييد ﻹدراج حكم يقصر صراحة نطاق انطباق مشروع المواد على حالات خلافة الدول التي تحدث وفقا للقانـون الدولي، بيد أن سؤالا طرح بخصوص ما إذا كان يمكن أن تحدث خلافة للدول لا تفي بهذا الشرط.

It should also address “connected issues”, i.e. issues which are intrinsically consequential to the change of nationality upon a succession of States.

لا يجوز للدولة الخلف التي ليست من الدول المستقلة حديثا والتي تظل معاهدة نافذة إزاءها عقب خلافة للدول أن تصوغ اعتراضا على تحفظ لم تعترض عليه الدولة السلف، إلا إذا كانت مهلة صوغ الاعتراض لم تنقض قبل تاريخ خلافة الدول وتم الاعتراض في حدود هذه المهلة.

A successor State, other than a newly independent State, in respect of which a treaty continues in force following a succession of States shall be considered as maintaining any express acceptance by the predecessor State of a reservation formulated by a contracting State or by a contracting organization.
