ما لم تنص المعاهدة على خلاف ذلك أو ما لم تكن الممارسة المعتادة التي تتبعها الجهة الوديعة مختلفة، يعتبر إبداء التحفظ بعد انقضاء المهلة المحددة مقبولا من الطرف المتعاقد إذا لم يعترض هذا الطرف على إبداء التحفظ قبل انتهاء مهلة الاثني عشر شهرا التي تلي إشعاره بالتحفظ.
