The Committee recommends that the State party implement, as appropriate, the Convention, and invites it to provide in its next periodic report information on the relationship of article 4 to Canon Law and Penal Law in Vatican City State.
397- توصي اللجنة بأن تطبق الدولة الطرف الاتفاقية، حسب الاقتضاء، وتدعوها إلى أن تقدم في تقريرها الدوري المقبل، معلومات عن صلة المادة 4 من الاتفاقية بالقانون الكنسي وقانون العقوبات في دولة الفاتيكان.

The Holy See, in the name of Vatican City State, was privileged to take part in the World Telecommunication Development Conference in Istanbul in March, and to make a number of the following observations.
وقد شرُف الكرسي الرسولي بالاشتراك باسم دولة الفاتيكان في المؤتمر العالمي لتطوير الاتصالات السلكية واللاسلكية الذي عقد في استانبول في شهر آذار/مارس، وإبداء عدد من الملاحظات التالية.

While welcoming the Holy See's approach to ensuring that the legislation of Vatican City State complies with the Convention, the Committee regrets that the same approach has not been followed in relation to its internal laws, including Canon Law.
13- ترحّب اللجنة بنهج الكرسي الرسولي الرامي إلى ضمان امتثال تشريعات دولة الفاتيكان للاتفاقية، لكنها تأسف في نفس الوقت لعدم اتباع النهج عينه فيما يتّصل بقوانينها الداخلية، ومنها القانون الكنسي.

The Committee is, however, concerned that the Holy See has not established a mechanism to monitor respect for and compliance with children's rights by individuals and institutions operating under its authority, including all Catholic schools, worldwide and in Vatican City State.
غير أنّ اللجنة تشعر بالقلق إزاء عدم إنشاء الكرسي الرسولي آلية لرصد احترام المؤسسات والأفراد العاملين تحت سلطته لحقوقَ الأطفال وامتثالهم لها، بما في ذلك كل المدارس الكاثوليكية، على الصعيد العالمي وفي دولة الفاتيكان.

(b) Amend the Canon Law and Vatican City State laws to explicitly prohibit all corporal punishment of children, including within the family;
(ب) تعديل القانون الكنسي وقوانين دولة الفاتيكان لحظر كل أشكال العقوبة البدنية للأطفال، بما في ذلك داخل الأسرة، حظراً صريحاً؛

While welcoming the extensive statistical information provided in the State party's report concerning the membership and administrative structure of the Roman Catholic Church as well as Catholic educational establishments globally, the Committee invites the State party to provide data on the inhabitants and administrative structure of Vatican City State.
399- واللجنة وإن كانت ترحّب بالمعلومات الاحصائية المفصلة المقدمة في تقرير الدولة الطرف فيما يتعلق بالعضوية في الكنيسة الرومانية الكاثوليكية وهيكلها الإداري، فضلاً عن المؤسسات التعليمية الكاثوليكية على المستوى العالمي، فإنها تدعو الدولة الطرف إلى تقديم بيانات عن سكان دولة الفاتيكان وهيكلها الإداري.

(ج) قانون دولة الفاتيكان التاسع المؤرخ 11 تموز/يوليه 2013 والذي يتضمن تعديلات على القانون الجنائي وقانون الإجراءات الجنائية؛

The establishment of a special office within the Governorate of Vatican City State to oversee the implementation of international agreements to which Vatican City State is a party, on 10 August 2013.
(ﻫ) استحداث منصب خاص داخل ديوان دولة الفاتيكان للإشراف على تنفيذ الاتفاقات الدولية التي تكون دولة الفاتيكان طرفاً فيها، في 10 آب/أغسطس 2013.

While welcoming the adoption of Vatican City State laws No. VIII and No. IX, which penalize offences under the Optional Protocol, the Committee is concerned that the application of those laws is restricted to the territory of Vatican City State and that they do not apply to all individuals and institutions operating under the supreme authority of the Holy See.
11- ترحب اللجنة بقانوني دولة الفاتيكان الثامن والتاسع، اللذين يعاقبان على الجرائم المنصوص عليها في البروتوكول الاختياري، لكنها قلقة من أن تطبيقهما يقتصر على أراضي دولة الفاتيكان وأنهما لا ينطبقان على الأفراد والمؤسسات الخاضعة لسلطة الكرسي الرسولي العليا.

The Committee urges the Holy See to bring all its norms and regulations, including Canon Law, into line with the Optional Protocol and ensure that the same laws apply to Vatican City State and individuals and institutions operating under its supreme authority.
12- تحث اللجنة الكرسي الرسولي على أن يجعل جميع قواعده ولوائحه، بما فيها القانون الكنسي، متوافقة مع أحكام البروتوكول الاختياري، وأن يحرص على أن تنطبق نفس القوانين على دولة الفاتيكان والأفراد والمؤسسات الخاضعة لسلطته العليا.

While welcoming the adoption, in July 2013, of Vatican City State laws No. VIII containing Complementary Norms on Penal Matters, Title II: Crimes against Children, and No. IX containing Amendments to the Criminal Code and the Criminal Procedure Code, the Committee is concerned that:
27- ترحب اللجنة باعتماد دولة الفاتيكان القانون الثامن الذي يتضمن " المعايير التكميلية بشأن القضايا الجنائية " ، الباب الثاني: الجرائم في حق الأطفال، والقانون التاسع الذي يتضمن " التعديلات على القانون الجنائي وقانون الإجراءات الجنائية " ، لكنها تشعر بالقلق بسبب ما يلي:

Laws No. VIII and No. IX apply only to Vatican City State and do not address offences committed by individuals and institutions under the authority of the Holy See, which continue to be subject to Canon Law provisions;
(أ) لا ينطبق القانونان الثامن والتاسع إلا على دولة الفاتيكان ولا يتناولان الجرائم التي يرتكبها أفراد ومؤسسات خاضعة لسلطة الكرسي الرسولي، ذلك أن أولئك الأفراد وتلك المؤسسات تخضع لأحكام القانون الكنسي؛

The Committee is aware of the dual nature of the Holy See's ratification of the Convention on the Rights of the Child as the Government of the Vatican City State and also as a sovereign subject of international law having an original, non-derived legal personality independent of any territorial authority or jurisdiction.
8- تدرك اللجنة الطبيعة المزدوجة لتصديق الكرسي الرسولي على اتفاقية حقوق الطفل بصفة حكومة دولة الفاتيكان وأيضاً بصفة شخص من أشخاص القانون الدولي ذي سيادة ويتمتع بشخصية قانونية فريدة ومستقلة عن أي سلطة أو ولاية قضائية إقليمية.

(a) Conduct a comprehensive assessment of the budgetary resources necessary for the implementation of the rights of children in Vatican City State and for the promotion and protection of children's rights by Catholic organizations and institutions in other States parties;
(أ) إجراء تقييم شامل لموارد الميزانية اللازمة لإعمال حقوق الطفل في دولة الفاتيكان ولتعزيز وحماية المنظمات والمؤسسات الكاثوليكية لحقوق الطفل في الدول الأطراف الأخرى؛

Since 1935, Cuba has maintained uninterrupted relations at the highest diplomatic level with the Vatican; and for several decades, Cuban Evangelical Churches have been part of the World Council of Churches, with headquarters in Geneva.
ومنذ عام 1935، حافظت كوبا دون انقطاع على تمثيل دبلوماسي على أرفع المستويات مع دولة الفاتيكان ؛ وتشارك كنائس إنجيلية كوبية منذ عدة عقود في المجلس العالمي للكنائس الكائن مقره في جنيف.
