Such an agreement may be entered into with respect to an entire international watercourse or any part thereof or a particular project, programme or use except insofar as the agreement adversely affects, to a significant extent, the use by one or more other watercourse States of the waters of the watercourse, without their express consent.
ويجوز عقد مثل هذا الاتفاق فيما يتعلق بكامل المجرى المائي الدولي، أو بأي جزء منه، أو بمشروع أو برنامج أو استخدام معين، إلا بقدر ما يضر هذا الاتفاق، إلى درجة ذات شأن، باستخدام مياه المجرى المائي من جانب دولة أو أكثر من دولة من دول المجرى المائي اﻷخرى، دون موافقة صريحة منها.

Before a watercourse State implements or permits the implementation of planned measures that may have a significant adverse effect upon other watercourse States, it should provide those States with timely notification thereof.
وقبل أن تنفذ دولة من دول المجرى المائي أو تسمح بتنفيذ التدابير المقررة التي قد تكون لها آثار سلبية على دول المجرى المائي الأخرى، ينبغي أن تخطر تلك الدول بتلك التدابير في الوقت المناسب.

" 1. This Convention shall not alter the rights and obligations of a watercourse State arising under other agreements in force on the date on which it becomes a party to this Convention.
" ١ - ينبغي ألا تغير هذه الاتفاقية حقوق وواجبات دولة من دول المجرى المائي الناشئة بموجب اتفاقات أخرى معمول بها في التاريخ الذي تصبح فيه طرفا في هذه الاتفاقية.

Before a watercourse State implements or permits the implementation of planned measures which may have a significant adverse effect upon other watercourse States, it shall provide those States with timely notification thereof.
قبل أن تقوم دولة من دول المجرى المائي أو أن تسمح بتنفيذ تدابير مزمع اتخاذها يمكن أن يكون لها أثر ضار ذو شأن على دول أخرى من دول المجرى المائي، عليها أن توجﱢه إلى تلك الدول إخطارا بذلك في الوقت المناسب.

2. We propose that artificial canals be excluded, so that canals dug between a watercourse State and another State do not entail the other State becoming a watercourse State.
٢ - نقترح استبعاد القنوات الصناعية وذلك حتى لا تصبح القنوات التي تشق بين دولة من دول المجرى المائي ودولة أخرى سببا في أن تصبح تلك الدولة اﻷخرى إحدى دول المجرى المائي.

" 4. Where a watercourse State considers that adjustment or application of the provisions of this convention is required, watercourse States shall consult with a view to negotiating in good faith for the purpose of concluding a watercourse agreement or agreements. " Article 7. Obligation not to cause significant harm
" ٤ - عندما ترى دولة من دول المجرى المائي أن تكييف أحكام هذه الاتفاقية أو تطبيقها ضروري، تتشاور دول المجرى المائي بغية التفاوض بحسن نية بقصد عقد اتفاق أو اتفاقات مجرى مائي " .

5. Where a watercourse State considers that adjustment and application of the provisions of the present Convention is required because of the characteristics and uses of a particular international watercourse, watercourse States shall consult with a view to negotiating in good faith for the purpose of concluding a watercourse agreement or agreements.
٥ - عندما ترى دولة من دول المجرى المائي أن مواءمة أحكام هذه الاتفاقية أو تطبيقها ضروريان بسبب خصائص مجرى مائي دولي معين واستخداماته، تتشاور دول المجرى المائي بغية التفاوض بحسن نية بقصد عقد اتفاق أو اتفاقات مجرى مائي.

(a) a watercourse State providing a notification under article 12 shall allow the notified States a period of six months within which to study and evaluate the possible effects of the planned measures and to communicate the findings to it;
)أ( تمهل أي دولة من دول المجرى المائي وجﱠهت إخطارا بموجب المادة ١٢ الدول التي تم إخطارها فترة ستـة أشهـر تقـوم خلالهـا بدراسة وتقييـم اﻵثـار الممكنة للتدابير المزمـع اتخاذهـا وبإبلاغ ما توصلت إليه من نتائج إليها؛

1. If a watercourse State has reasonable grounds to believe that another watercourse State is planning measures that may have a significant adverse effect upon it, the former State may request the latter to apply the provisions of article 12.
١ - إذا كان لدى دولة من دول المجرى المائي أسباب معقولة للاعتقاد بأن دولة أخرى من دول المجرى المائي تزمع اتخاذ تدابير يمكن أن يكون لها أثر ضار ذو شأن عليها، جاز للدولة اﻷولى أن تطلب إلى الدولة الثانية تطبيق أحكام المادة ١٢.

Such an agreement may be entered into with respect to any part thereof or a particular project, programme or use, [provided that the agreement does not adversely affect], [except insofar as the agreement adversely affects] to a significant extent, the use by one or more other watercourse States of the waters of the watercourse.
ويجوز عقد مثل هذه الاتفاق فيما يتعلق بأي جزء منه أو بمشروع أو برنامج أو استخدام معين، ]بشرط ألا يؤثر هذا الاتفاق تأثيرا سلبيا[ بدرجة جسيمة، في استخدام مياه المجرى المائي من جانب دولة أو أكثر من دولة من دول المجرى المائي اﻷخرى.

23. With regard to article 3, paragraph 2, her delegation wished to propose a drafting amendment to the Spanish version of the phrase " provided that the agreement does not adversely affect, to a significant extent, the use by one or more other watercourse States of the waters of the watercourse. " The term " menoscabe " was not appropriate.
٢٣ - وفيما يتعلق بالفقرة ٢ من المادة ٣ فإن وفد اﻷرجنتين يود اﻹعراب عن اقتراح بشأن صياغة النص الاسباني لعبارة " بشرط ألا يؤثر هذا الاتفاق تأثيرا سلبيا بدرجة جسيمة في استخدام مياه المجرى المائي من جانب دولة أو أكثر من دولة من دول المجرى المائي اﻷخرى " إن لفظة " menos cabe " غير ملائمة.

" قبل أن تقوم دولة من دول المجرى المائي أو تسمح بتنفيذ تدابير مزمع اتخاذها يمكن أن ينجم عنها أثر سلبي ملموس على دول أخرى من دول المجرى المائي، عليها أن تقدم الى تلك الدول إخطارا بذلك في الوقت المناسب.

Since the actions taken by one watercourse State could affect the groundwater of another watercourse State, deleting the term " groundwaters " might make it impossible to impute legal liability in the case of harm caused to a third State.
فحيث إن من الممكن أن تؤثر اﻹجراءات التي تتخذها دولة من دول المجرى المائي على دولة أخرى من دول المجرى المائي، فإن حذف عبارة المياه الجوفية قد يجعل من المستحيل تحديد المسؤولية القانونية في حالة حدوث ضرر لدولة ثالثة.
