وفي هذا الصدد، نشير الى الاستنتاج الذي توصلت إليه محكمة العدل الدولية باﻹجماع في فتواها الصادرة في عام ١٩٩٦ والقائلة إن هناك التزاما بمتابعة المفاوضات بحسن نية واختتامها بهدف التوصل الى نزع السلاح النووي بجميع جوانبه تحت رقابة دولية دقيقة وفعالة.

20. Nuclear-weapon-free zones have made important contributions to nuclear disarmament and more generally towards general and complete disarmament under strict and effective international control.
٢٠ - وما فتئت المناطق الخالية من اﻷسلحة النووية تسهم إسهاما هاما في نزع السلاح النووي وبصفة أعم في نزع السلاح العام الشامل في ظل مراقبة دولية دقيقة وفعالة.

Moreover, the International Court of Justice has stated that there exists an obligation for all States to pursue in good faith and to bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.
وعلاوة على ذلك، ذكرت محكمة العدل الدولية أنه يترتب التزام على جميع الدول بأن تواصل مسعاها بنية خالصة وأن تتوصل الى خاتمة للمفاوضات تؤدي إلى نزع السلاح النووي من كافة نواحيه تحت رقابة دولية دقيقة وفعالة.

The same intention was found in article VI of the Treaty, which set forth the undertaking of each of the Parties to pursue negotiations in good faith on effective measures relating to cessation of the nuclear arms race at an early date and to nuclear disarmament, and on a treaty on general and complete disarmament under strict and effective international control.
وتلاحظ نفس اﻹرادة في المادة السادسة من المعاهدة التي تنص على تعهد كل طرف من اﻷطراف بمواصلة إجراء المفاوضات بحسن نية بشأن التدابير الفعالة المتعلقة بوقف سباق التسلح النووي في موعد قريب، وبنزع السلاح النووي، وبشأن معاهدة نزع السلاح العام الكامل تحت رقابة دولية دقيقة وفعالة.

The Commission recalls the advisory opinion of July 1996 of the International Court of Justice on the Legality of the Threat or Use of Nuclear Weapons, which concluded that there exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.
وتذكر الهيئة بفتوى محكمة العدل الدولية في تموز/يوليه 1996 بشأن مشروعية التهديد باستعمال الأسلحة النووية أو استعمالها والتي خلصت إلى وجود التزام لمواصلة السعي إلى القيام بنية حسنة بإجراء وإنجاز مفاوضات مؤدية إلى تحقيق نزع السلاح النووي في جميع جوانبه تحت مراقبة دولية دقيقة وفعالة.

فهو جزء لا يتجزأ من هدفنا المشترك النهائي الذي اتفقنا عليه في عام 1961 وهو " نزع السلاح العام والكامل في ظل رقابة دولية دقيقة وفعالة " .

We should recall the Advisory Opinion tendered by the International Court of Justice on the legality of the threat or use of nuclear weapons and declare that all members of the international community should consider themselves bound by the obligation, expressly recognized by the Court, to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.
وينبغي لنا أن نشير إلى فتوى محكمة العدل الدولية بشأن مشروعية التهديد باستخدام اﻷسلحة النووية أو استخدامها وأن نعلن أنه يتعين على جميع أعضاء المجتمع الدولي اعتبـــــار أنفسهم ملتزمين بهذا الالتزام الذي اعترفت بـــــه المحكمة صراحة بالتفاوض بحسن نية واختتام المفاوضات من أجل تحقيق نزع السلاح النووي بجميع جوانبه تحت رقابـــة دولية دقيقة وفعالة.

(k) Strengthen efforts towards general and complete disarmament under strict and effective international control, based on the priorities established by the United Nations in the field of disarmament, so that released resources could be used for, inter alia, social and economic programmes which benefit women and girls;
(ك) تكثيف الجهود من أجل نزع السلاح العام الكامل في إطار مراقبة دولية دقيقة وفعالة استنادا إلى الأولويات التي تحددها الأمم المتحدة في مجال نزع السلاح، بما يتيح استخدام الموارد غير المستعملة في مجالات من بينها البرامج الاجتماعية والاقتصادية التي تعود بالنفع على النساء والفتيات؛

2. Belarus is convinced that the establishment of a nuclear-weapon-free space in Central and Eastern Europe would make an important contribution to the strengthening of an international nuclear non-proliferation regime and to global efforts aimed at achieving the ultimate objectives of eliminating nuclear weapons and, more broadly speaking, of general and complete nuclear disarmament under strict and effective international control.
2 - وحسبما تعتقد، بيلاروس، فإن إنشاء منطقة خالية من الأسلحة النووية في وسط وشرق أوروبا سيشكل إسهاما مهما في تعزيز إقامة نظام دولي لمنع الانتشار النووي، ودعم الجهود العالمية الرامية إلى بلوغ الأهداف النهائية المتمثلة في إزالة الأسلحة النووية، وبعبارة أعم، التوصل إلى نزع السلاح النووي العام والكامل في ظل رقابة دولية دقيقة وفعالة.

In this regard, the establishment of nuclear-weapon-free zones on the basis of arrangements freely arrived at among the States of the region concerned constitutes an important contribution to the strengthening of the nuclear non-proliferation regime, to the achievement of nuclear disarmament and to global efforts aimed at achieving the ultimate objective of eliminating nuclear weapons under strict and effective international control.
وفي هذا المجال، فإن إقامة مناطق خالية من الأسلحة النووية على أساس ترتيبات يتم التوصل إليها بحرية بين دول المنطقة المعنية يشكل إسهاما هاما لتعزيز نظام عدم انتشار الأسلحة النووية، ولتحقيق نزع السلاح النووي والجهود العالمية الرامية إلى تحقيق الهدف النهائي لإزالة الأسلحة النووية في إطار مراقبة دولية دقيقة وفعالة.

وإذ تشير إلى فتوى محكمة العدل الدولية بشأن مشروعية استخدام اﻷسلحة النووية أو التهديد باستخدامها بأنه يوجد التزام على جميع الدول بأن تواصل وتختتم بنية طيبة مفاوضات تؤدي إلى نزع السلاح النووي بجميع جوانبه في ظل رقابة دولية دقيقة وفعالة)٤٠(،

With that in mind, Egypt reiterates its strong support for the ICJ 1996 Advisory Opinion on the Legality of the Threat or Use of Nuclear Weapons, which concluded that " There exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control. "
ومن هذا المنطلق، تؤكد مصر مجدداً تأييدها القوي لفتوى محكمة العدل الدولية بشأن مشروعية التهديد بالأسلحة النووية أو استخدامها، والتي جاء في ختامها " يوجد التزام بمواصلة المفاوضات بنيات حسنة واختتامها بحيث تؤدي إلى نزع السلاح بجميع جوانبه تحت رقابة دولية دقيقة وفعالة " .

30. The States Parties in particular the nuclear-weapon States shall inform the Secretary-General of the United Nations of the efforts and measures they have taken on the implementation of the unanimous conclusion of the International Court of Justice that there exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.
30 - وتقوم الدول الأطراف، ولا سيما الدول الحائزة للأسلحة النووية، بإبلاغ الأمين العام للأمم المتحدة عن الجهود التي بذلتها والتدابير التي اتخذتها بشأن تنفيذ النتائج التي توصلت إليها محكمة العدل الدولية بالإجماع بخصوص وجود التزام بإجراء مفاوضات بنية حسنة واختتامها اختتاما يؤدي إلى نزع السلاح النووي من جميع جوانبه بموجب مراقبة دولية دقيقة وفعالة.

133 (m) bis To strengthen efforts towards general and complete disarmament under strict and effective international control, based on the priorities established by the United Nations in the field of disarmament, so that released resources can be used for social and economic programmes which benefit women/which are of prime importance for women and children in order to guarantee the full implementation of the Platform for Action;

Mr. Hasmy (Malaysia) recalled that when the States parties to the Non-Proliferation Treaty had agreed at the 1995 Conference to extend the Treaty indefinitely, the nuclear-weapon States parties had reaffirmed their commitment to pursue in good faith negotiations aimed at reducing and ultimately eliminating nuclear weapons under strict and effective international control.
50 - السيد حاسمي (ماليزيا): أشار إلى أنه عندما وافقت الدول الأطراف في معاهدة عدم الانتشار في مؤتمر عام 1995 على تمديد المعاهدة إلى أجل غير مسمى، أكدت الدول الحائزة للأسلحة النووية من جديد التزامها بمواصلة المفاوضات بنية حسنة بغية تخفيض الأسلحة النووية والقضاء عليها في نهاية المطاف بموجب ضوابط دولية دقيقة وفعالة.
