8.1 With respect to the allegation that the author was arrested without a warrant and that this was only issued more than three days after the arrest, in contravention of national legislation which stipulates that a warrant must be issued within 72 hours of arrest, the Committee notes that this matter has not been addressed by the State party.
8-1 وفيما يتعلق بالادعاء بأن صاحب البلاغ اعتقل دون مذكرة توقيف وأن هذه المذكرة لم تصدر إلا بعد ما يزيد على ثلاثة أيام من توقيفه، إخلالاً بأحكام التشريع الوطني، الذي ينص على وجوب إصدار مذكرة توقيف في غضون 72 ساعة من التوقيف، تلاحظ اللجنة أن الدولة الطرف لم تتناول هذه المسألة.

3.4 The author claims that his father's arrest on 19 April 1990 by the internal security services, without a warrant and without informing him of the legal grounds for his arrest, was carried out in complete disregard of the guarantees set forth in article 9, paragraphs 1 and 2, of the Covenant.
3-4 ويدّعي صاحب البلاغ أن اعتقال أجهزة الأمن الداخلي والده في 19 نيسان/ أبريل 1990، دون مذكرة توقيف ودون إعلامه بأسباب اعتقاله، قد تمّ دون أدنى اعتبار للضمانات الواردة في الفقرتين 1 و2 من المادة 9 من العهد.

In all those cases, the persons detained: (a) were arrested without a warrant and either not formally charged or charged months later; (b) had been held at various detention centres and prisons for varying periods of time without being brought before a judge; (c) were charged with anti-State and terrorist activities; and (d) had either never stood trial or were tried by the Specialized Penal Courts.

8.10 The Committee is of the view that the facts before it show that, given that the State party arrested Mourad Chihoub at the age of 16 when he was still a minor, without an arrest warrant or any explanation, and then detained him incommunicado and deprived him of all contact with his family for 15 years, the State party did not ensure the special protection required for children under 18 years of age.
8-10 وترى اللجنة أن الوقائع المعروضة عليها تبين أن الدولة الطرف، باعتقالها مراد شيهوب عندما كان قاصراً يبلغ السادسة عشرة من العمر، دون مذكرة توقيف ودون أي تفسير، واحتجزته في مكان سري وعزلته عن العالم الخارجي وحرمته من أي اتصال بعائلته لمدة 15 سنة، تكون قد تقاعست عن ضمان الحماية الخاصة المطلوب توفيرها للأطفال الذين تقل أعمارهم عن 18 عاماً.
