We therefore welcome enthusiastically the entry into force in April 2003 of the 1993 Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas as a sign of significant progress.

There is now a prevailing view that Fishing Vessels on the High Seas which are not effectively controlled by their flag States are liable to sanctions by other States, should they happen to contravene international conservation and management measures.

For example, the Food and Agriculture Organization of the United Nations (FAO) developed the Code of Conduct for Responsible Fisheries and the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas, which is known as the Compliance Agreement.
فعلى سبيل المثال وضعت منظمة اﻷمم المتحدة لﻷغذية والزراعة مدونة قواعد الســلوك لصيد اﻷسماك المتسم بالمسؤولية والاتفاق المتعلق بتعزيز امتثال سفن الصيد في أعالي البحار لتدابير الحفظ واﻹدارة الدولية، والمعــروف باتفاق الامتثــال.

122. Azerbaijan stressed that it had taken effective measures in accordance with international law to prevent reflagging of vessels by its nationals for the purpose of avoiding compliance with applicable conservation and management rules for Fishing Vessels on the High Seas.

17. Where there are reasonable grounds for suspecting that a fishing vessel on the high seas is without nationality, a State may board and inspect the vessel.
