36. In this context, it should be noted that judicial independence is guaranteed by the Constitution, which in article 65 clearly provides that magistrates are independent and subject to no authority other than the law.
36- ويجب التذكير في هذا الصدد بأن استقلال القضاء يكفله الدستور الذي ينص الفصل 65 منه بوضوح على أن " القضاة مستقلون لا سلطان عليهم في قضائهم لغير القانون " .

3. Article 1 of the Statutes of the Judiciary stipulates that: " Judges are independent and, in their administration of justice, are subject to no authority other than the Islamic Shariah and the regulations in force.
3- نصت المادة الأولى من نظام القضاء على أن " القضاة مستقلون لا سلطان عليهم في قضائهم لغير أحكام الشريعة الإسلامية والأنظمة المرعية، وليس لأحد التدخل في القضاء " .

32- ولا يمكن إغفال أن المؤسسة القضائية هي الميدان الرئيس لإحقاق الحقوق وإعمالها فالقضاء سلطة مستقلة قضائياً ومالياً وإدارياً والنيابة العامة هيئة من هيئاته، وتتولى المحاكم الفصل في جميع المنازعات والجرائم، والقضاة مستقلون لا سلطان عليهم في قضائهم لغير القانون.

207. At the forefront of the guarantees provided under Tunisian law is the right of a party to have his case heard before a competent, independent and an impartial court created in accordance with the provisions of the law. Article 65 of the Constitution provides that judges are independent and are subject to no authority other than the law.
207- في طليعة الضمانات التي يقرها القانون التونسي حق المتقاضي في أن تنظر في قضيته محكمة مختصة مستقلة ونزيهة مشكلة وفق أحكام القانون وحسب الفصل 65 من الدستور فإن القضاة مستقلون لا سلطان عليهم في قضائهم لغير القانون.

وفقاً لمبادئ الدستور فأن السلطة القضائية في العراق تمثل سلطة مستقلة استناداً إلى مبدأ الفصل بين السلطات المادة (47) من الدستور وتشير إحكام المواد (87 ،88) إلى أن السلطة القضائية مستقلة وان القضاة مستقلون لا سلطان عليهم في قضائهم لغير القانون ولا يجوز لأية سلطة التدخل في القضاء أو في شؤون العادلة.

" Article 131 states: " Judges are independent and are subject to no authority other than the law and there can be no interference in legal proceedings or in the administration of justice. "
كما أكدّ في المادة 130 على أن " السلطة القضائية مستقلة وتتولاها المحاكم على اختلاف أنواعها ودرجاتها " ، ونصت المادة 131 على أن " القضاة مستقلون، لا سلطان عليهم في قضائهم لغير القانون ولا يجوز لأية جهة التدخل في القضايا أو في سير العدالة " .

The Constitution recognizes the importance of the honesty and impartiality of judges in ensuring people's rights and freedoms. Article 131 stipulates: " Judges are independent and are subject to no authority other than the law. No authority has the right to interfere in the administration of justice. "
وقد عول الدستور على شرف القضاة وتجردهم لضمان حقوق الناس وحرياتهم، حيث نصت المادة 131 على أن " القضاة مستقلون، لا سلطان عليهم في قضائهم لغير القانون ولا يجوز لأية جهة التدخل في القضايا أو في سير العدالة " .

Article 130 provides: " The judiciary is independent. Judicial power is exercised by courts of various kinds at different levels. " Article 131 states: " Judges are independent and are subject to no authority other than the law. No party has the right to interfere in legal cases or in the administration of justice. "
كما أكد في المادة 130 على أن " السلطة القضائية مستقلة وتتولاها المحاكم على اختلاف أنواعها ودرجاتها " ، ونصت المادة 131 على أن " القضاة مستقلون، لا سلطان عليهم في قضائهم لغير القانون ولا يجوز لأية جهة التدخل في القضايا أو في سير العدالة " .
