وفي كل مرة تؤدي فيها مسألة التعويض الى إثارة خلاف، يجب أن يسوى الخلاف بمقتضى التشريع المحلي للدولة المؤممة ومن قبل محاكمها، إلا اذا اتفقت جميع الدول المعنية، اتفاقا حرا ومتبادلا، على التماس وسائل سلمية أخرى تقوم على تساوي الدول في السيادة وتتفق مع مبدأ حرية اختيار الوسائل.

1. In the event of a dispute between any two or more Parties concerning the interpretation or application of the present Protocol, the Parties concerned shall seek a settlement of the dispute through negotiation or any other peaceful means of their own choice.
١- في حالة قيام خلاف بين أي طرفين أو أكثر فيما يتعلق بتفسير أو تطبيق هذا البروتوكول، تسعى اﻷطراف المعنية إلى تسوية الخلاف عن طريق التفاوض أو أي وسيلة سلمية أخرى تختارها.
