Fusas asserted that the performance bond in the amount of USD 57,280 could not be released because Fusas was unable to complete the project works due to Iraq's invasion and occupation of Kuwait.
وأكـدت شركة فوساس أنه تعذر الإفراج عن سند ضمان الأداء البالغ 280 57 دولاراً من دولارات الولايات المتحدة لأنها لم تستطع إنجاز أعمال المشروع بسبب غزو العراق واحتلاله للكويت.

With respect to its claim for the unrecovered performance bond, Fusas failed to provide a copy of the performance bond or any independent proof of actual payment.

Dutch Agro provided a copy of a document dated 17 July 1990, issued by the Credit Lyonnais Bank Nederland N.V., requesting the Commercial Bank of Kuwait S.A.K. to issue to KISR, on behalf of Dutch Agro, the performance bond attached to the request.
