It would also be necessary to examine the possibility of regulating the question of concurrent responsibility in cases where the Organization assumed international responsibility vis-à-vis the host State but where the wrongful act was due to gross negligence or wilful misconduct by members of national contingents in the United Nations force.

By its resolution 52/177, the General Assembly resolved that all mission-related death and disability should be compensable unless there was gross negligence or wilful misconduct on the part of the injured or deceased and requested the Secretary-General to settle all death and disability cases within three months.
وقررت الجمعة العامة في قرارها 52/177 أنه ينبغي دفع تعويضات عن كل حالات الوفاة والعجز الناجمة عن الخدمة في البعثات إلا إذا حصل تقصير جسيم أو سوء سلوك متعمد من جانب الفرد المصاب أو المتوفى، وطلبت إلى الأمين العام تسوية جميع مطالبات التعويض عن الوفاة والعجز في غضون ثلاثة أشهر.

13. The Secretariat processes death and disability cases for troops/formed police units without waiting for a board of inquiry report, when the force commander/ police commissioner confirms that there has been no evidence in the investigation to indicate any gross negligence or wilful misconduct on the part of the contingent/ formed police unit member.
13 - تتولى الأمانة العامة تجهيز مطالبات التعويض عن الوفاة والعجز المتصلة بالقوات/وحدات الشرطة المشكلة بدون انتظار تقرير من مجلس التحقيق، عندما يؤكد قائد القوة/مفوض الشرطة عدم وجود دليل عقب التحقيق يثبت وجود أي تقصير جسيم أو سوء سلوك متعمد من جانب الفرد في الوحدة العسكرية أو في وحدة الشرطة المشكلة.

The user troop/police contributor shall be responsible for reimbursing the providing troop/police contributor, through the United Nations, for any damage that may occur, whether as a result of wilful misconduct, gross negligence or negligence by personnel of the user troop/police contributor.

In the case of the contingent member, if the force commander confirms that it was a mission-related death and there was no prima facie evidence of gross negligence or wilful misconduct on the part of the contingent/police member, the Member State will be paid $50,000 with the assurance that the amount paid to the duly recognized beneficiaries of the deceased will not be less than what is received from the United Nations.

10. The Government will reimburse the United Nations for loss of or damage to United Nations-owned equipment and property caused by the personnel or equipment provided by the Government if such loss or damage (a) occurred outside the performance of services or any other activity or operation under this Agreement, or (b) arose or resulted from gross negligence or wilful misconduct of the personnel provided by the Government.
٠١ - تدفع الحكومة لﻷمم المتحدة تعويضات لقاء فقد أو تلف المعدات والممتلكات المملوكة لﻷمم المتحدة يتسبب به أفراد أو معدات مقدمة من الحكومة إذا ما حصل هذا الفقد أو التلف )أ( خارج نطاق أداء خدمات أو غيرها من اﻷنشطة والعمليات بموجب هذا الاتفاق، أو )ب( إذا نشأ أو نتج عن إهمال جسيم أو سوء سلوك متعمد من جانب اﻷفراد الذين تقدمهم الحكومة.

٠١ - تدفع الحكومة لﻷمم المتحدة تعويضات لقاء فقد أو تلف المعدات والممتلكات المملوكة لﻷمم المتحدة يتسبب به أفراد أو معدات مقدمة من الحكومة إذا ما حصل هذا الفقد أو التلف )أ( خارج نطاق أداء خدمات أو غيرها من اﻷنشطة والعمليات بموجب هذه المذكرة، أو )ب( إذا نشأ أو نتج عن إهمال جسيم أو سوء سلوك متعمد من جانب اﻷفراد الذين تقدمهم الحكومة.

When the force commander/police commissioner confirms that: (a) the death was mission-related; (b) the investigation found that there was no evidence of gross negligence or wilful misconduct on the part of the contingent/formed police unit member; and (c) the Member State is entitled to a full death award, the Secretariat does not wait for the completion of the board of inquiry process to settle the claims.
وعندما يؤكد قائد القوة أو مفوض الشرطة ما يلي: (أ) حصول الوفاة لسبب متعلق بالبعثة؛ و (ب) عدم وجود دليل عقب التحقيق يثبت حدوث تقصير جسيم أو سوء سلوك متعمد من جانب الفرد في الوحدة العسكرية/وحدة الشرطة؛ و (ج) يحق للدولة العضو الحصول على التعويض الكامل عن الوفاة، لا تنتظر الأمانة العامة لتسوية المطالبات إنجاز مجلس التحقيق مهمته.

In addition, the Secretariat processes death and disability claims for military contingents/formed police units without waiting for a board of inquiry report in cases when the force commander/police commissioner confirms that there has been no evidence in the investigation to indicate any gross negligence of wilful misconduct on the part of the contingent/formed police unit member (A/63/550, para. 13).
وبالإضافة إلى ذلك، تجهز الأمانة العامة عمليات المطالبات بتعويض الوفاة والعجز للوحدات العسكرية/وحدات الشرطة المشكلة دون انتظار تقرير من مجلس التحقيق، متى أكد قائد القوة/مفوض الشرطة أن ليس هناك دليل في التحقيق على وجود تقصير جسيم أو سوء سلوك متعمد من جانب أحد أفراد الوحدات/الشرطة المشكلة (A/63/550، الفقرة 13).
