It further recalls that the right of all accused of a criminal charge to defend themselves in person or through legal counsel of their own choosing, or to have legal assistance assigned to them free of charge whenever the interests of justice so require, is provided for by article 14, paragraph 3 (d).
وتشير كذلك إلى أن حق جميع المتهمين بتهم جنائية في أن يدافعوا عن أنفسهم شخصياً أو بواسطة محام من اختيارهم، وأن تزودهم المحكمة، كلما كانت مصلحة العدالة تقتضي ذلك، بمحام يدافع عنهم دون تحميلهم أجراً على ذلك، منصوص عليه في الفقرة 3(د) من المادة 14().

The minimum rights prescribed by this Article also encompass the right of the accused to be tried in his presence and to defend himself in person or by legal assistance of his/her own choosing and to have legal assistance assigned to him/her, in any case where the interests of justice so require, and without payment by him/her in any such case if he/she does not have sufficient means to pay for it.
وتشمل الحقوق الدنيا المنصوص عليها في هذه المادة أيضاً حق المتهم في أن يحاكم حضورياً وفي الدفاع عن نفسه شخصياً أو بواسطة محام يختاره بنفسه وأن تخصص له مساعدة قانونية كلما اقتضت الحاجة ذلك تحقيقاً لمصلحة العدالة ودون تحميله تكاليف تلك المساعدة إذا لم تكن لديه الإمكانات الكافية لتحملها.

(d) shall be afforded facilities to examine in person or by his legal representative the witnesses called by the prosecution before any court and to obtain the attendance of witnesses, subject to the payment of their reasonable expenses, and carry out the examination of such witnesses to testify on his behalf before the court on the same conditions as those applying to witnesses called by the prosecution; and
)د( ينبغي أن تتاح له تسهيلات كيما يستجوب شخصياً أو بواسطة ممثله القانوني الشاهد الذي يستدعيه الادعاء أمام المحكمة وأن يسمح له باستدعاء شهود، شريطة أن يدفع نفقاتهم المعقولة، وأن يقوم باستجواب هؤلاء الشهود للشهادة لصالحه أمام المحكمة وفقاً لنفس الشروط المطبقة على الشهود الذين يستدعيهم الادعاء؛ و

7.2 The Committee takes note of the author's claims that he was tried and convicted in first instance and on appeal by courts made up of faceless judges, without the due safeguards of a public hearing and adversarial proceedings, and in particular that he was not allowed to be present and defend himself during the trial, either personally or through his representative, and had no opportunity to question the prosecution witness.
7-2 وتحيط اللجنة علماً بادعاء صاحب البلاغ أنه حوكِم وأُدين في محكمة ابتدائية ومحكمة استئناف تألفتا من قضاة مجهولي الهوية، ومن دون توفير الضمانات الواجبة المتمثلة في المحاكمة العلنية والمقاضاة الحضورية، لا سيما وأنه لم يُسمح له بالحضور والدفاع عن نفسه أثناء المحاكمة، سواء كان ذلك شخصياً أو بواسطة محاميه، كما أنه لم يُمنح فرصة استجواب شاهد الادعاء.
