The European Court considered the admissibility of the author's complaint on 3 October 2002.

On the strength of that reasoning, the Committee concludes that the author's complaint is incompatible ratione materiae with the Covenant and, thus, inadmissible under article 3 of the Optional Protocol.

The Committee also notes that the Prosecutor's Office conducted investigations into the petitioner's complaint on six separate occasions and that each investigation came to the conclusion that the facts of the case revealed that the leaflets were meant to target and expose the two individuals who were named as authors of the leaflets.
