10. Priority of a security right registered in a specialized registry or noted on a title certificate
10- أولوية الحق الضماني المسجّل في سجل متخصّص أو المؤشر بشأنه على شهادة ملكية

a. Registration in a specialized registry or notation on a title certificate
أ- التسجيل في سجل متخصّص أو التأشير على شهادة ملكية

A fifth priority conflict may arise between a security right in an asset that later became an attachment and a security right in the relevant movable asset to which the attachment was attached where both rights have been made effective against third parties by registration in a specialized registry or notation on a title certificate.
أما النوع الخامس من النـزاع على الأولوية فهو الذي يمكن أن ينشأ بين حق ضماني في موجود أصبح فيما بعد ملحقا وحق ضماني في الموجود المنقول ذي الصلة الذي أضيف إليه الملحق عندما يجعل الحقّان معا نافذين تجاه الأطراف الثالثة بتسجيلهما في سجل متخصص أو التأشير بشأنهما في شهادة ملكية.

Finally, under other law in many States, a security right in a specific type of movable property can be registered in a title registry (for example, a ship's registry) or noted on a title certificate.
وأخيرا، يمكن في العديد من الدول، بمقتضى قانون آخر، تسجيل الحق الضماني في نوع معين من الممتلكات المنقولة في سجل لحقوق الملكية (كسجل سفينة على سبيل المثال) أو التأشير بشأنه على شهادة ملكية.

(b) A security right that is subsequently registered in the specialized registry or noted on a title certificate.

A fourth type of priority conflict may arise between two security rights in assets that later became attachments to one or more movable assets where both rights have been made effective against third parties by registration in a specialized registry or notation on a title certificate.
والنوع الرابع من النـزاع على الأولوية هو الذي يمكن أن ينشأ بين حقين ضمانيين في موجودات أصبحت فيما بعد ملحقات لموجود منقول واحد أو أكثر عندما يُجعل الحقّان معا نافذين تجاه الأطراف الثالثة بتسجيلهما في سجل متخصص أو التأشير بشأنهما في شهادة ملكية.

However, if the security right has not been made effective against third parties by registration in a specialized registry or notation on a title certificate, a transferee, lessee or licensee takes its rights free of the security right.
غير أنه إذا لم يكن الحق الضماني قد جُعل نافذا تجاه الأطراف الثالثة بواسطة التسجيل في سجل متخصص أو بالتأشير بشأنه على شهادة ملكية فإن المحال إليه أو المستأجر أو الحاصل على الترخيص يأخذ حقوقه خالية من الحق الضماني.

The law should provide that a security right in movable property that is subject to registration in a specialized registry or notation on a title certificate under law other than this law may be made effective against third parties by registration as provided in recommendation 33 or by:
