4.1 In its observations dated 9 July 2013, the State party considers the communication to be inadmissible ratione materiae because the author does not have a disability as defined under the Convention.

In the present case, the Committee finds that the age limitation of allowing only partners who have reached the age of 60 years to obtain an entitlement to various rate reductions as a partner to a pensioner above the age of 65 years is an objective criterion of differentiation and that the application of this differentiation in the case of the author was not unreasonable.

In that respect, the author is not asking the Committee to make findings about the adequacy, promptness or transparency of the investigation carried out into her son's death.
وفي هذا الخصوص، فإن صاحبة البلاغ لا تطلب من اللجنة أن تخلص إلى نتائج بشأن كفاية أو سرعة أو شفافية التحقيق الذي تم بشأن وفاة ابنها.

The author's claims are based not on any treatment that she will suffer at the hands of the State party, but on consequences that she may suffer if she is returned to Burundi.

4.8 Lastly, the State party observes that the author does not state in her communication that she is not pursuing a remedy under another procedure of international investigation or settlement.

6.3 In relation to the alleged violation of article 7 of the Covenant by the State party, the Committee notes that the author does not claim that her husband was subjected to torture on the territory of Uzbekistan and/or by the Uzbek law enforcement officers.

4.10 The State party considers that the author does not run a real risk of being subjected to treatment in violation of article 7 of the Covenant if returned to Bangladesh.

4.11 As far as the alleged violation of article 13 of the Covenant is concerned, the State party maintains that article 13 is not applicable in the present case because the author is not in Canada legally.

4.2 Concerning the violation of the right to equal treatment under article 14, paragraph 1, of the Covenant, the State party points out that the author makes no claim of a distinction based on arbitrary or unreasonable treatment, and emphasizes that her account of the events is a subjective one.
