4.2 The State party notes that the complainant did not inform it of her allegations that she had been raped at the time of her departure from Ndjili airport in 2001.
4-2 وأشارت الدولة الطرف إلى أن صاحبة الشكوى لم تبلغها بمزاعم تعرضها للاغتصاب أثناء مغادرتها مطار ندجيلي في عام 2001.

It states that the complainant has failed to establish that she would face a personal, real and foreseeable risk of torture upon her return to the Democratic Republic of the Congo.
وادعت أن صاحبة الشكوى لم تقدم ما يثبت أنها تواجه شخصياً خطراً حقيقياً ومحدقاً يتمثل في تعرضها للتعذيب عند عودتها إلى جمهورية الكونغو الديمقراطية.

The State party concludes that the complainant has not established that she would face a risk of torture because of her own political activities.

3.2 The State party notes that the complainant's activities were at a relatively low level and maintains that she has not demonstrated that she would risk " disproportionate punishment " if tried in Turkey.
3-2 وتشير الدولة الطرف إلى أن أنشطة صاحبة الشكوى كانت على مستوى منخفض نسبياً، وتؤكد أن صاحبة الشكوى لم تثبت أنها ستكون معرضة لتسليط " عقوبة غير متناسبة " عليها إن تمت محاكمتها في تركيا.

Therefore, the State party maintains that she has not substantiated her claims that her relatives are missing and she lacks a social network in the Democratic Republic of the Congo or that it would not be possible for her to relocate to Mushenge, where her parents live, upon her return to the Democratic Republic of the Congo.
وتفيد الدولة الطرف بالتالي بأن صاحبة الشكوى لم تثبت أن أقاربها مفقودون وأنها تفتقر إلى شبكة اجتماعية في جمهورية الكونغو الديمقراطية أو أنه سيستحيل عليها الانتقال إلى بلدة موشينج، التي يعيش فيها والداها، عند عودتها إلى البلد.

For the State party, it is surprising that the complainant did not present this essential piece of evidence in the ordinary procedure, nor in the procedure for revision before ARK.

The State party points out that the complainant only disclosed that she had had problems with the authorities in Colombo in November 2009, while her initial application for asylum was made in May 2009, and that according to her she was not sought individually, but because the authorities persecuted all Tamils.
وتُلفت الدولة الطرف النظر إلى أن صاحبة الشكوى لم تبلِّغ بأنه كانت لديها مشكلات مع السلطات في كولومبو إلا في تشرين الثاني/نوفمبر 2009، علماً بأن طلب اللجوء الأولي الذي قدمته يعود إلى أيار/مايو 2009 وأنها ذكرت أنها لم تكن مستهدفة بمفردها وإنما لأن السلطات تضطهد جميع التاميل.

However, the complainant's claims did not appear plausible to ARK, since, according to it, the complainant had neither substantiated nor proven psychological obstacles to at least mentioning the rape in the initial interview.
